The Secretary of State, in exercise of the powers conferred on him by section 12A(1) of and paragraphs 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Highland Primary Care National Health Service Trust (Establishment) Amendment Order 1999 and shall come into force on 1st April 1999.

(2) In this Order “the principal Order” means the Highland Primary Care National Health Service Trust (Establishment) Order 1998(2).

Amendment of the principal Order

2.—(1) For article 3 of the principal Order there shall be substituted the following:–

“3.—(1) The Trust is established for the purposes specified in section 12A(1) of the Act.

(2) The Trust’s functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the Trust for one or more Health Boards) shall be:–

(a)to own and manage under section 12A(1)(a) of the Act and to provide and manage under section 12A(1)(b) of the Act, the hospital establishments or facilities specified in the Schedule to this order and establishments associated with those hospitals, including any refurbishments and replacements thereof and including the management of the facilities provided at and from those establishments, and also including the management of any teaching and research facilities associated with these establishments and the support services related thereto; and

(b)to acquire and dispose of land, buildings and other property whether referred to in the Schedule or not, which appears to the Trust to be necessary or expedient for the purpose of, or in connection with the carrying out of its functions referred to in paragraph (2)(a) of this article.”.

(2) The Schedule annexed to this Order shall be added to the principal Order.

Explanatory Note

This Order substitutes a new article 3 and Schedule in the Highland Primary Care National Health Service Trust (Establishment) Order 1998.
