The Minister of Agriculture, Fisheries and Food, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on him by that section, and of all other powers enabling him in that behalf, hereby makes the following Regulations—

Title and commencement

1.  These Regulations may be cited as the Habitat (Water Fringe) (Amendment) Regulations 1999 and shall come into force on 17th December 1999.

Interpretation

2.  In these Regulations “the principal Regulations” means the Habitat (Water Fringe) Regulations 1994(3).

Amendment of the principal Regulations

3.  After regulation 4 of the principal Regulations there shall be inserted the following regulation—

“Closing date for accepting applications for aid

4A.  The Minister shall not accept an application under these Regulations in respect of any period beginning in the year 2000 or any subsequent year.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Habitat (Water Fringe) Regulations 1994 (S.I. 1994/1291) (as amended) (“the principal Regulations”) which implement in part a zonal programme approved by the European Commission under article 7 of Council Regulation (EEC) No. 2078/92 (OJ No. L215, 30.7.92, p.85) (“the agri-environment Regulation”) on agricultural methods compatible with the requirements of the protection of the environment and the maintenance of the countryside. The agri-environment Regulation was repealed by Article 55(1) of Council Regulation (EC) No. 1257/99 (OJ No. L160, 26.6.99, p.80) but, by virtue of Article 55(3) of the latter Regulation, the agri-environment Regulation continues to apply to actions approved by the Commission before 1st January 2000.
These Regulations amend the principal Regulations to provide that the Minister shall not accept any applications for aid for any period beginning in the year 2000 or any subsequent year (regulation 3).
No regulatory impact assessment has been prepared in respect of these Regulations.
