The Minister of Agriculture, Fisheries and Food and the Secretaries of State respectively concerned with the sea fishing industry in Scotland, Wales and Northern Ireland, acting jointly, in exercise of the powers conferred on them by sections 5(1), 15(3), 20(1) and 22(2)(a) of the Sea Fish (Conservation) Act 1967(1) and of all other powers enabling them in that behalf, hereby makes the following Order:

Title and commencement

1.  This Order may be cited as the Bass (Specified Areas) (Prohibition of Fishing) (Variation) Order 1999 and shall come into force on 15th February 1999.

Variation of the Bass (Specified Areas) (Prohibition of Fishing) Order 1990

2.—(1) The Bass (Specified Areas) (Prohibition of Fishing) Order 1990(2) shall be varied in accordance with the following paragraphs of this article.

(2) In article 2 (prohibition) after the words “(Dicentrarchus labrax)” there shall be inserted the following words–

“, or fishing for any species of sea-fish using sand-eels (Ammodytidae) as bait,”.

(3) For the Schedule there shall be substituted the Schedule set out in the Schedule to this Order.

Revocation

3.  The Bass (Specified Areas) (Prohibition of Fishing) (Variation) Order 1992(3) is hereby revoked.

The area enclosed by Bee Ness Jetty and a line drawn 204° true to the tip of Oakham Ness Jetty, thence 260° true to the SE tip of Kingsnorth Jetty, and along the seaward arm of Kingsnorth Jetty and then 298° true to the Kingsnorth power station foreshore

All tidal waters enclosed by a line drawn 180° true from the eastern end of the Dungeness 'A' building to a point 600 m below MLW Springs, thence 270° true for a distance of 1 km, thence 000° true to the shore marked by an isolated building “hangar B1” situated between the Dungeness 'B' complex and the Power Station

All tidal waters enclosed by a line drawn 192° true from Eastoke Point to Chichester Bar Beacon, then 078° true to Cakeham Tower

Explanatory Note

(This note is not part of the Order)
This Order varies the Bass (Specified Areas) (Prohibition of Fishing) Order 1990 (S.I. 1990/1156) (“the principal Order”).
The Order varies the principal Order to prohibit fishing for sea fish using sand eels for bait in the areas, and during the periods, specified in the Schedule to the Order (article 2(2)).
The Order substitutes a new Schedule for the Schedule set out in the principal Order (article 2(3)).
The Bass (Specified Areas) (Prohibition of Fishing) (Variation) Order 1992 is revoked (article 3).
A single regulatory impact assessment has been prepared in relation to both this Order and the Sea Fish (Specified Sea Area) (Regulation of Nets and Prohibition of Fishing Methods) (Variation) Order 1999 (S.I. 1999/74) and deposited in the Libraries of both Houses of Parliament.
