Coming into force in accordance with article 1
The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (East Coast) (No. 3) (Scotland) Partial Revocation Order 1999 and shall come into force at 18.00 hours on 16th November 1999.

Revocation

2.  The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (East Coast) (No. 3) (Scotland) Order 1999(2) is revoked insofar as it designates any part of the area set out in the Schedule to this Order.

Article 2
SCHEDULE
The area of sea below high water springs enclosed by a line starting at a point close to Portgordon at 57°40'N 3°W; then west and north along the shoreline of the mainland of Scotland to a point north of Wick in Sinclairs Bay at 58°30'N 3°08'W; then east to a point at 58°30'N 3°W; then south to the start point.
Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (East Coast) (No. 3) (Scotland) Order 1999 which prohibited–
(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4);
(b)movement of such scallops out of that area (article 5); and
(c)landing, using in the preparation of processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6).
The effect of this Order is to remove the prohibitions in respect of the area of sea described in the Schedule to this Order.
