The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Broxtowe Borough Council, South Somerset District Council and Thurrock Borough Council) Order 1999 and shall come into force on 4th March 1999.

Exemption of maintenance of ground

2.—(1) The maintenance of ground(2) by Broxtowe Borough Council shall not be treated as a defined activity so long as it is carried out during the period beginning with the date on which this Order comes into force and ending immediately before 1st January 2001, in the following parishes of the borough–

Awsworth

Brinsley

Cossall

Eastwood

Greasley

Kimberley

Nuthall

Strelley

Trowell

(2) The maintenance of ground by Thurrock Borough Council shall not be treated as a defined activity so long as it is carried out during the period beginning with 1st October 1999 and ending immediately before 1st October 2000.

Exemption of collection of refuse and other cleaning

3.—(1) The collection of refuse(3) and other cleaning(4) by South Somerset District Council shall not be treated as defined activities so long as they are carried out during the period beginning with the date on which this Order comes into force and ending immediately before 1st May 2001.

(2) The collection of refuse and other cleaning by Thurrock Borough Council shall not be treated as defined activities so long as they are carried out during the period beginning with 1st October 1999 and ending immediately before 1st October 2000.

Explanatory Note

(This note is not part of the Order)
Under Part I (competition) of the Local Government Act 1988 work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
Paragraph (1) of article 2 of this Order allows Broxtowe Borough Council to carry out ground maintenance in the parishes mentioned from 4th March 1999 to (and including) 31st December 2000. Paragraph (2) of that article allows Thurrock Borough Council to carry out that activity from 1st October 1999 to (and including) 30th September 2000.
Paragraph (1) of article 3 allows South Somerset District Council to carry out refuse collection and the cleaning of streets, street name plates and traffic signs, the emptying of gullies and litter bins and the removal of litter from 4th March 1999 to (and including) 30th April 2001. Paragraph (2) of that article allows Thurrock Borough Council to carry out those activities from 1st October 1999 to (and including) 30th September 2000.
