CRIMINAL PROCEDURE
The Proceeds of Crime (Northern Ireland) Order 1996 (Code of Practice) Order 1998

Whereas—
(a)in pursuance of paragraph 8(1) of Schedule 2 (hereinafter referred to as “the Schedule”) to the Proceeds of Crime (Northern Ireland) Order 1996(1) (hereinafter referred to as “the Order”) the Secretary of State is under a duty to make a Code of Practice in connection with the exercise by financial investigators of the powers conferred by the Schedule;
(b)in pursuance of paragraph 8(2) of the Schedule to the Order the Secretary of State has prepared and published a draft Code of Practice in connection with the said matter and has considered representations made to her thereon and modified the draft code accordingly;
(c)in pursuance of paragraph 8(3) of the Schedule to the Order the Secretary of State has laid a draft of the Code of Practice before both Houses of Parliament:

Now, therefore, the Secretary of State, in exercise of the powers conferred on her by paragraph 8(3) of the Schedule to the Order, hereby makes the following order:—

Citation and commencement

1.  This order may be cited as the Proceeds of Crime (Northern Ireland) Order 1996 (Code of Practice) Order 1998 and shall come into operation on 26th June 1998.

Code of Practice

2.  The Code of Practice laid in draft before Parliament on 22nd January 1998 in connection with the exercise by financial investigators of the powers conferred by the Schedule to the Order shall come into operation on 26th June 1998.

Explanatory Note

(This note is not part of the Order.)
This Order appoints 26th June 1998 as the date on which the Code of Practice in pursuance of paragraph 8(1) of Schedule 2 to the Proceeds of Crime (Northern Ireland) Order 1996 will come into operation. The Code of Practice is connected with the exercise by financial investigators of the powers conferred by Schedule 2 to the Proceeds of Crime (Northern Ireland) Order 1996.
A copy of this Code of Practice will be available for public consultation at all police stations during periods when they are open for public business.
