Whereas in pursuance of section 53(1)(a) of the Northern Ireland (Emergency Provisions) Act 1996(1) (“the 1996 Act”) the Secretary of State has made a code of practice in connection with the silent video recording of interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989(2).
And whereas in pursuance of section 54(3) of the 1996 Act the Secretary of State has made an order bringing the code into operation on 11th March 1998(3);

Now, therefore, in exercise of the powers conferred on her by section 53(1)(b) of the 1996 Act, the Secretary of State hereby orders as follows:

1.  This Order may be cited as the Northern Ireland (Emergency Provisions) Act 1996 (Silent Video Recording of Interviews) Order 1998 and shall come into force on 11th March 1998.

2.  Interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989 which commence after midnight on 10th March shall be subject to silent video recording in accordance with the code of practice on silent video recording as it has effect for the time being.

Explanatory Note

(This note is not part of the Order)
This Order requires the silent video recording of interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989.
The Order comes into force on 11th March 1998 and applies to interviews commencing after midnight on 10th March 1998.
