The Secretary of State for the Environment, Transport and the Regions and the Secretary of State for Wales, acting jointly in exercise of the powers conferred by section 1(5) of the Local Authorities (Goods and Services) Act 1970(1), hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (No. 3) Order 1998 and shall come into force on 21st May 1998.

Designation of public bodies

2.  Each of the following, being a person appearing to the Secretary of State for the Environment, Transport and the Regions and to the Secretary of State for Wales to be exercising functions of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to England and Wales:

Newham Healthcare Trust

Bristol Regeneration Partnership Limited

West Euston Partnership Limited

The Institute of Burial and Cremation Administration.

Restrictions on agreements

3.—(1) The restrictions in paragraph (2) below shall not apply in relation to the Institute of Burial and Cremation Administration.

(2) Agreements which may be entered into by virtue of this Order—

(a)by Newham Healthcare Trust shall be restricted to agreements with the London Borough of Newham for the supply of goods or materials or the provision of administrative, professional or technical services by that authority to that body in respect of Newham General Hospital and within that authority’s area; and

(b)by Bristol Regeneration Partnership Limited or West Euston Partnership Limited shall be restricted to agreements with a local authority for the supply of goods or materials or the provision of administrative, professional or technical services by that authority to that body, in connection with financial or other assistance given or to be given to that body by any person for the purposes of the regeneration of any part of that authority’s area.

Explanatory Note

(This note is not part of the Order)
Article 2 of this Order designates Newham Healthcare Trust, Bristol Regeneration Partnership Limited, West Euston Partnership Limited and the Institute of Burial and Cremation Administration as public bodies under section 1(5) of the Local Authorities (Goods and Services) Act 1970.
The effect of designation is to allow a local authority to provide goods and services to the designated bodies. By virtue of Article 3(2)(a), the only authority permitted to do so in relation to Newham Healthcare Trust is the London Borough of Newham in respect of Newham General Hospital within that authority’s area. By virtue of Article 3(2)(b), an authority may only do so in relation to Bristol Regeneration Partnership Limited and West Euston Partnership Limited if the provision is in connection with financial or other assistance to those bodies by any person for the purposes of the regeneration of any part of that authority’s area.
