At the Council Chamber, Whitehall, the 21st day of April 1998

By the Lords of Her Majesty’s Most Honourable Privy Council

Their Lordships, in exercise of the powers conferred upon Them by sections 48(1) and 60 of the Further and Higher Education (Scotland) Act 1992(1) and all other powers enabling them in that behalf, are pleased to order, and it is hereby ordered, as follows:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Academic Awards and Distinctions (Queen Margaret College) (Scotland) Order of Council 1998 and shall come into force on 1st June 1998.

(2) In this Order—

“the Act” means the Further and Higher Education (Scotland) Act 1992;

“the Institution” means Queen Margaret College, Edinburgh; and

“the 1993 Order” means the Academic Awards and Distinctions (Queen Margaret College) (Scotland) Order of Council 1993(2)

Competence to grant academic awards and distinctions

2.—(1) The Institution is hereby specified as competent to grant all such degrees, diplomas, certificates and other academic awards and distinctions as may be granted in pursuance of subsections (2) and (3) of section 48 of the Act.

(2) The appropriate date for the purposes of paragraph (a) of section 48(2) of the Act shall be 1st June 1998.

Transitional provision

4.  Notwithstanding the date specified in Article 2(2) of this Order, where a course of study was completed before that date and in accordance with the 1993 Order the Institution was competent to grant an award or distinction in respect of it, the Institution shall remain competent to grant that award or distinction.

N. H. Nicholls

Explanatory Note

(This note is not part of the Order)
The Academic Awards and Distinctions (Queen Margaret College) (Scotland) Order of Council 1993 specified Queen Margaret College as competent to grant degrees, diplomas, certificates or other academic awards or distinctions with the specific exception of awards granted in respect of completion of a programme of supervised research. This Order revokes that earlier Order, and gives the College power to grant all degrees, diplomas, certificates and other academic awards and distinctions that may be granted by virtue of section 48(2) and (3) of the Further and Higher Education (Scotland) Act 1992. The power conferred by this Order applies in respect of courses of study or programmes of research completed on or after 1st June 1998.
Article 4 of this Order contains a transitional provision. This enables the College to grant such degrees, diplomas, certificates or other academic awards and distinctions as it had power to grant under the 1993 Order of Council in respect of courses completed before 1st June 1998 but for which the appropriate award has not, by then, been made.
