The Secretary of State for the Environment, Transport and the Regions (as respects England) and the Secretary of State for Wales (as respects Wales), in exercise of the powers conferred on them by section 20 of the Land Compensation Act 1973(1), hereby make the following Regulations, a draft of which was laid before Parliament for 40 days during which period neither House of Parliament resolved that the Regulations should not be made(2):

Citation and commencement

1.  These Regulations may be cited as the Noise Insulation (Railways and Other Guided Transport Systems) (Amendment) Regulations 1998 and shall come into force on the tenth day after the day on which they are made.

Amendment of the Noise Insulation (Railways and Other Guided Transport Systems) Regulations 1996

2.  The Noise Insulation (Railways and Other Guided Transport Systems) Regulations 1996(3) shall be amended by the insertion in paragraph (1) of regulation 9 after the words “Calculation of Railway Noise 1995” of the words “and the supplement to that technical memorandum entitled Calculation of Railway Noise 1995 (Supplement 1)”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Noise Insulation (Railways and Other Guided Transport Systems) Regulations 1996 by adding procedures for predicting noise levels generated by “Eurostar” type trains including the version known as “Regional Eurostar” or “North of London”. Those procedures are described in “Calculation of Railway Noise 1995 (Supplement 1)” copies of which are obtainable by the public from The Stationery Office [ISBN 0 11 551873 8].

Since these Regulations were not the first to be made under section 20, a draft of them did not require to be approved by a resolution of each House of Parliament pursuant to subsection (9).
