The Crime and Disorder Act 1998 (Commencement No. 1) Order 1998

In exercise of the powers conferred upon him by section 121 of the Crime and Disorder Act 1998(1), the Secretary of State hereby makes the following Order:

1.  This Order may be cited as the Crime and Disorder Act 1998 (Commencement No. 1) Order 1998.

2.  The following provisions of the Crime and Disorder Act 1998 shall come into force on the day after the day on which this Order is made:

(a)section 41, for the purpose of making appointments under that section and under paragraph 1 of Schedule 2;

(b)section 49, for the purpose of making rules which make such provision as is mentioned in subsection (2) of that section;

(c)section 114;

(d)sections 116 and 117; and

(e)paragraphs 1 and 2 of Schedule 2, for the purpose of making appointments under section 41 and paragraph 1 of that Schedule.

3.  Section 84 of, and paragraph 9 of Schedule 9 to, the Crime and Disorder Act 1998 shall come into force on the seventh day after the day on which this Order is made.

Explanatory Note

(This note is not part of the Order)
This Order brings into force the provisions of the Crime and Disorder Act 1998 specified in articles 2 and 3. The provisions specified in article 2 make transitory and other minor provision and confer powers to appoint the members and Chairman of the Youth Justice Board and to provide that certain things which may be done by a single justice of the peace may be done by a justices' clerk. The provisions specified in article 3 make new provision relating to football spectators. All but the provisions relating to football spectators (which come into force a week after this Order is made) come into force the day after this Order is made.
By virtue of section 121(2) of the 1998 Act, sections 109, 111(8) and 122 and paragraphs 55, 99 and 117 of Schedule 8 came into force upon Royal Assent.
