The Competition Act 1998 (Commencement No. 1) Order 1998

The Secretary of State in exercise of the powers conferred on him by section 76 of the Competition Act 1998(1) hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Competition Act 1998 (Commencement No. 1) Order 1998.

(2) In this Order references to sections and Schedules are references to sections of and Schedules to the Competition Act 1998.

Appointed day

2.—(1) 26th November 1998 is the day appointed for the coming into force of–

(a)section 51 and Schedule 9 (Director’s rules) and section 52 (advice and information); and

(b)section 54(2) and paragraphs 2 to 8 of Schedule 10 (regulators) and section 59 (interpretation) for the purposes of the provisions which are brought into force by paragraph (a) above.

(2) The enactments and orders to which paragraphs 2 to 8 of Schedule 10 make amendments shall continue in force for all other purposes without the amendments made by those paragraphs.

Explanatory Note

(This note is not part of the Order)
This Order brings into force on 26th November 1998 section 51 and Schedule 9 of the Competition Act 1998 (the Act) which provide for the Director General of Fair Trading to make rules about procedural and other matters in connection with the carrying into effect of Part I of the Act. It brings into force on the same date section 52 which requires the Director to prepare and publish advice and information about the application of the Chapter I and Chapter II prohibitions and their enforcement. The Order brings into force for the purposes of sections 51 and 52 provisions as to the exercise of functions by the regulators (defined in section 59).
