Article 71(5) of the Race Relations (Northern Ireland) Order 1997 (“the 1997 Order”) provides that nothing in that Order invalidates any rules restricting employment in the service of the Crown or by public bodies prescribed under that Article to persons of particular birth, nationality, descent or residence. The same paragraph provides that the 1997 Order does not render unlawful the publication, display or implementation of such rules or the publication of advertisements stating the gist of such rules.
