The M4 Motorway (London Borough of Hounslow) (Bus Lane) Order 1998

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 6(1) and (3) of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984(1), and of all other powers enabling him in that behalf, and after consultation with the Commissioner of Police of the Metropolis pursuant to section 7(6) of that Act(2), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as The M4 Motorway (London Borough of Hounslow) (Bus Lane) Order 1998 and shall come into force on 1st January 1999.

Interpretation

2.  In this Order:

“bus” means a public service vehicle as defined in section 1 of the Public Passenger Vehicles Act 1981(3);

“taxi” has the meaning given in Regulation 4 of the Traffic Signs Regulations and General Directions 1994(4);

“motorway” has the meaning given in Regulation 3(1) of the Motorways Traffic (England and Wales) Regulations 1982(5);

“bus lane” means the right-hand or offside traffic lane of the eastbound carriageway of the M4 motorway between a point 19 metres east of marker post 21.8 and a point 12 metres west of marker post 16.0, a total distance of approximately 5.78 kilometres.

Prohibition

3.—(1) Subject to paragraph (2) no person shall cause or permit any vehicle to enter in or proceed in the bus lane.

(2) Paragraph (1) of this order shall not apply to:

(a)a bus, or a licensed taxi;

(b)a vehicle being used for police, ambulance or fire brigade purposes;

(c)anything done at the direction or with the permission of a police constable in uniform, or of a traffic warden; or

(d)a vehicle being used in connection with:

(i)the removal of any obstruction to traffic in or near the motorway,

(ii)the maintenance, improvement or reconstruction of the motorway or any adjoining road,

(iii)the laying, erection, alteration, or repair of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus as defined in Schedule 2 to the Telecommunications Act 1984(6) in or near the motorway, or

(iv)the placing, maintenance or removal of any traffic sign in or near the motorway.
