The Secretary of State, in exercise of the powers conferred upon him by section 1 of the Register of Sasines (Scotland) Act 1987(1), and of all other powers enabling him in that behalf, and after consultation in accordance with section 2(1) of that Act with such persons or bodies as appeared to him to be appropriate, hereby makes the following Regulations:

Citation, Commencement and interpretation

1.—(1) These Regulations may be cited as the Register of Sasines (Registers Direct) (Scotland) Regulations 1998 and shall come into force on 1st January 1999.

(2) In these Regulations–

“the Keeper” means the Keeper of the Registers of Scotland;

“the Register” means the Register of Sasines as construed in accordance with section 2 of the Land Registers (Scotland) Act 1868(2);

“Registers Direct service” means the service provided by the Keeper by virtue of regulation 2(1) below.

Inspection of the Register by Registers Direct service

2.—(1) The Keeper may make the Register or any part thereof available to the public for inspection by remote direct access by computer.

(2) An application may be made to the Keeper for use of the Registers Direct service.

(3) On making an application, an applicant shall submit such information as will enable the Keeper to be satisfied that suitable arrangements have been made for payment of any fees incurred by the applicant.

(4) Any user of the Registers Direct service shall, on being required to do so by the Keeper, submit such information as will enable the Keeper to be satisfied that the requirements of paragraph (3) above continue to be met.

Explanatory Note

(This note is not part of the Regulations)
These Regulations make provision for the Register of Sasines to be made available to the public for inspection by remote direct access by computer (regulation 2).
