Motor Vehicles (Construction and Use) (Amendment No. 2) Regulations (Northern Ireland) 1997

Coming into operation
1st October 1997

The Department of the Environment, in exercise of the powers conferred on it by Articles 55(1) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Construction and Use) (Amendment No. 2) Regulations (Northern Ireland) 1997 and shall come into operation on 1st October 1997.

Amendment of the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1989

2.  After regulation 99 of the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1989(2) there shall be inserted the following new regulation.

“Obstruction

99A.  No person in charge of a motor vehicle or trailer shall cause or permit the vehicle to stand on a road so as to cause any unnecessary obstruction of the road.”.

Explanatory Note

(This note is not part of the Regulations.)
These Regulations amend the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1989 by inserting a new regulation which makes it unlawful for a person to leave a vehicle or trailer where it causes unnecessary obstruction of the road.
