The Secretary of State, in pursuance of section 25 of the Police Act (Northern Ireland) 1970(1) and after consulting, in accordance with section 34(2) of that Act, the Police Authority and the Police Association and, in accordance with section 62(3) of the Police Act 1996(2), the Police Negotiating Board for the United Kingdom, hereby, with the concurrence of the Treasury, makes the following regulations:—

Citation and commencement

1.  These regulations may be cited as the Royal Ulster Constabulary Pensions (Additional Voluntary Contributions) (Amendment) Regulations 1997 and shall come into operation on 24th November 1997.

Amendment of the Royal Ulster Constabulary Pensions (Additional Voluntary Contributions) Regulations 1993

2.—(1) The Royal Ulster Constabulary Pensions (Additional Voluntary Contributions) Regulations 1993(3) shall be amended in accordance with paragraphs (2) and (3).

(2) In regulation 11(9)(a) for the words “£104” there shall be substituted the words “£260”.

(3) There shall be added, after regulation 18, the following regulation—

“Compliance with Inland Revenue requirements

19.  The Police Authority shall comply with the requirements of regulation 4 and, so far as they concern free-standing additional voluntary contributions schemes, of regulation 6 of the Retirement Benefits Schemes (Restriction on Discretion to Approve) (Additional Voluntary Contributions) Regulations 1993(4).”.

Explanatory Note

(This note is not part of the Regulations.)
These regulations amend the Royal Ulster Constabulary Pensions (Additional Voluntary Contributions) Regulations 1993.
Regulation 2(2) reflects increases made in certain maxima by the Occupational Pension Schemes (Preservation of Benefit) Regulations (Northern Ireland) 1991 (S.R. 1991 No. 37).
Regulation 2(3) requires the Police Authority to comply with the relevant provisions of the Requirement Benefit Schemes (Restriction on Discretion to Approve) (Additional Voluntary Contributions) Regulations 1993 (S.I. 1993/3016), regulation 4 of which restricts the discretion of the Commissioners of Inland Revenue to approve retirement benefit schemes which are free-standing additional voluntary contribution schemes where the rules of the scheme do not require the administrator of the scheme to comply with the requirements of that regulation and, so far as applicable, of regulation 6 of those regulations.
