The Secretary of State for Health makes the following Order in exercise of the powers conferred upon her by section 126(3) of the National Health Service Act 1977(1) and by section 5(1) of, and paragraphs 1 and 3 of Schedule 2 to, the National Health Service and Community Care Act 1990(2).

The Secretary of State for Health has completed the consultation prescribed under section 5(2) of the National Health Service and Community Care Act 1990(3).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the London Ambulance Service National Health Service Trust (Establishment) Amendment Order 2006 and shall come into force on 1st July 2006.

(2) In this Order “the Establishment Order” means the London Ambulance Service National Health Service Trust (Establishment) Order 1996(4).

Amendment of article 1 of the Establishment Order

2.  In article 1 of the Establishment Order (citation, commencement and interpretation), at the appropriate alphabetical place insert—

““community health services” means any services which the Secretary of State may provide under section 3(1)(d) or (e) of, or Schedule 1 to, the National Health Service Act 1977 and any service which she has a duty to provide under section 5(1) of that Act(5);”.

Amendment of article 3 of the Establishment Order

3.  In article 3 of the Establishment Order (nature and functions of the trust), for paragraph (2) substitute—

“(2) The trust’s functions shall be to provide goods and services for the purposes of the health service and, in particular, to provide and manage—

(a)ambulance and associated transport services; and

(b)such other services, including community health services, as can reasonably be carried out in conjunction with the provision and management of ambulance and associated transport services.”.

Explanatory Note

(This note is not part of the Order)
This Order amends the London Ambulance Service National Health Service Trust (Establishment) Order 1996.
Article 3 amends the functions of the London Ambulance Service National Health Service Trust to provide that the functions of the trust shall include in particular the provision and management of ambulance and associated transport services and other services including community health services which are compatible with the provision and management of those ambulance and associated transport services.
A full regulatory impact assessment has not been produced for this Order as it has no impact on the costs of business, charities or voluntary bodies.
