1.—(1) This Order may be cited as the Returning Officers (Parliamentary Constituencies) (England) (Amendment) Order 1997 and shall come into force on 1st April 1997.

Explanatory Note

(This note is not part of the Order)
Article 2 of this Order amends Schedule 1 to the Returning Officers (Parliamentary Constituencies) (England) Order 1995 (“the 1995 Order”) to substitute the name of the District of Brighton and Hove, which is created by the East Sussex (Boroughs of Brighton and Hove) (Structural Change) Order 1995 (S.I. 1995/1770), for the name of the District of Brighton (which will cease to exist on 1st April 1997).
Article 3 of this Order amends Schedule 2A of the 1995 Order in consequence of the creation of the County of Rutland by the Leicestershire (City of Leicester and District of Rutland) (Structural Change) Order 1996 (S.I. 1996/507). As a conseqence of the creation of that county, the Rutland and Melton constituency will straddle two counties and section 24(1)(a) of the Representation of the People Act 1983 (which applies where a constituency is wholly contained in a county) no longer operates to determine the returning officer for that constituency.
