The Council of the Royal College of Veterinary Surgeons, in exercise of the powers in section 11 of the Veterinary Surgeons Act 1966(1), has made the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2007 (“the Regulations”) set out in the Schedule to the following Order.
Under section 25(1) of that Act, the Regulations do not have effect unless approved by order of the Privy Council.

In exercise of the power in section 25(1) and (2) of the Veterinary Surgeons Act 1966, their Lordships make the following Order:

Title and commencement

1.    This Order may be cited as the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations Order of Council 2007 and comes into force on 1st April 2008.

Approval

2.    The Regulations set out in the Schedule are approved.

Revocation

3.    The Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations Order of Council 2006(2) is revoked.

SCHEDULETHE VETERINARY SURGEONS AND VETERINARY PRACTITIONERS (REGISTRATION) (AMENDMENT) REGULATIONS 2007

The Council of the Royal College of Veterinary Surgeons, in exercise of its powers under section 11 of the Veterinary Surgeons Act 1966(3), makes the following amendment to the Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005(4).

Citation

1.  These Regulations may be cited as the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2007.

Amendments to the Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005

2.  The Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005 are amended as follows.

3.  In regulation 10(1), for “; and”, substitute “.”.

4.  In regulation 13(1)(a) and (c), for “regulation 3”, substitute “paragraph 3”.

5.  In regulations 13(1)(a), 13(2)(a), 13(3)(a), 15(2), 17, 18(1), 18(2) and 18(3), for “regulation 2”, substitute “paragraph 2”.

6.  In regulation 13(2)(a) and (3)(a), for “regulation 4”, substitute “paragraph 4”.

7.  For the title to Part IX (fees payable by veterinary surgeons and veterinary practitioners) substitute “Fees Payable by Veterinary Surgeons and Veterinary Practitioners for Retention and Registration”.

8.  In regulation 14, for “regulation 1”, substitute “paragraph 1”.

9.  In regulation 18(5), for “regulation 2(iv)”, substitute “paragraph 2(iv)”.

10.  Omit regulation 19.

11.  In regulation 20(b), for “regulation 5”, substitute “paragraph 5”.

12.  In regulation 23(1), for “regulation 2(iii)”, substitute “paragraph 2(iii)”.

13.  After regulation 23 insert—

“23A.  The Schedule shall have effect.”.

14.  For the Schedule (Table of Fees Payable) substitute—

EXPLANATORY NOTE

(This note is not part of the Order)

This Order approves the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2007 (“the Regulations”) made on 7th June 2007 by the Council of the Royal College of Veterinary Surgeons (“the RCVS”) under section 11 of the Veterinary Surgeons Act 1966. The Regulations make minor amendments to the Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005 (“the 2005 Regulations”) and replace the Schedule to the 2005 Regulations with a new Schedule (Table of fees payable).

This Order comes into force on 1st April 2008. This Order revokes the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations Order of Council 2006.

The Regulations provide for an increase in fees payable for annual registration and retention of names on the registers of the RCVS as set out in the Schedule. The increase in fees for all categories of membership is no greater than 3%, except for a retention fee for a person registered in the supplementary register under section 8 of the Veterinary Surgeons Act 1966, or for the restoration of a name to the supplementary register, the fees for which are not increased. Fees for temporary registration have been decreased. No fee is charged for non-practising veterinary surgeons over 70 years of age on 1st April of the year in which a fee would otherwise be due.

The increase in fees payable set out above has been determined by the Council of the RCVS. The new fees represent the amounts deemed necessary by the Council of the RCVS for the effective administration of the RCVS.

A full impact assessment has not been produced for this Order as a minimal impact on the private or voluntary sectors is foreseen.
