In exercise of the powers conferred on the Secretary of State by sections 17(4) and 26(3) of the Local Government Act 1992(1), the Secretary of State for Education and Employment hereby makes the following Order:

Citation and Commencement

1.  This Order may be cited as the Local Government Changes for England (Education) (Miscellaneous Provisions) Order 1997 and shall come into force on 1st April 1997.

Hampshire County Council: functions in respect of specified schools

2.—(1) The functions of the Council of the County of Hampshire referred to in paragraph (2) below shall on and after 1st April 1997 be discharged by the Southampton City Council(2).

(2) The functions referred to in paragraph (1) are functions of the Council of the County of Hampshire in respect of the following schools—

Kanes Hill County Primary School;

Netley Court Special School;

Townhill County Infants School; and

Townhill County Junior School;

including any functions of the local education authority under the articles of government for any of these schools.

Staffordshire County Council: functions in respect of Aynsley Special School

3.  The functions of the Council of the County of Staffordshire in respect of Aynsley Special School (including any functions of the local education authority under the articles of government for that school) shall on and after 1st April 1997 be discharged by Stoke-on-Trent City Council(3).

St George’s Roman Catholic Grant-maintained School, Southampton

4.  St George’s Roman Catholic Grant-maintained School shall be treated for all purposes connected with education as if it were wholly within the area of the City of Southampton.

Explanatory Note

(This note is not part of the Order)
This Order provides for the exercise on and after 1st April 1997 of functions in respect of specified schools in consequence of the transfer of certain local authority functions from the Hampshire County Council to the Southampton City Council and from the Staffordshire County Council to the Stoke-on-Trent City Council.

The Hampshire (Cities of Portsmouth and Southampton) (Structural Change) Order 1995 (S.I. 1995/1775) provides for the functions of Hampshire County Council in relation to the City of Southampton to be transferred to the Council of that City from 1st April 1997.

The Staffordshire (City of Stoke-on-Trent) (Structural and Boundary Changes) Order 1995 (S.I. 1995/1779) provides for the functions of Staffordshire County Council in relation to the City of Stoke-on-Trent to be transferred to the Council of that City from 1st April 1997.
