The Energy Information (Washing Machines) (Amendment) Regulations 1997

The Secretary of State, being a Minister designated(1) for the purposes of section 2(2)(a) of the European Communities Act 1972(2) in relation to measures relating to energy labelling and standard product information for household products, in exercise of the powers conferred by section 2(2) of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations—

Citation and commencement

1.  These Regulations may be cited as the Energy Information (Washing Machines) (Amendment) Regulations 1997 and shall come into force on 15th May 1997.

Amendments

2.  The Energy Information (Washing Machines) Regulations 1996(3)are amended as follows—

(a)in regulation 2 (interpretation)—

(i)in the definition of “the Directives”, for “and Commission Directive 95/12/EC” substitute “Commission Directive 92/75/EEC and Commission Directive 96/89/EC”(4); and

(ii)after that definition add—

““enforcement action” means the instituting of proceedings (whether criminal or otherwise) for failing to observe or comply with these Regulations;”; and

(b)in regulation 3(3) (application)—

(i)omit “or” from the end of sub-paragraph (e); and

(ii)at the end add—

“(g)until 30th June 1998 machines with no internal means to heat water.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations exclude washing machines with no internal means to heat water from the provisions of the Energy Information (Washing Machines) Regulations 1996 to implement Commission Directive 96/89/EC. The earlier Regulations implemented Council Directive 92/75/EEC and Commission Directive 95/12/EC. The 1996 Directive added these machines to article 1 of the 1995 Directive, which excluded other machines from its scope. These Regulations also add a definition of “enforcement action” to the earlier Regulations.
