The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, after completion of the consultation prescribed under section 5(2) of the latter Act(3), considering it appropriate that the functions of the trust should include functions in relation to the provision of services for one or more Health Authorities(4), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Calderdale Healthcare National Health Service Trust (Establishment) Amendment Order 1997 and shall come into force on 24th March 1997.

Amendment of NHS trust Establishment Order

2.  In Article 3 of the Calderdale Healthcare National Health Service Trust (Establishment) Order 1992(5) (functions of the trust) –

(a)in paragraph (1) for “section 5(1)(a)” there shall be substituted “section 5(1)(b)”; and

(b)for paragraph (2) there shall be substituted the following new paragraph:—

“(2) The trust’s functions shall be –

(a)to provide and manage hospital accommodation and services at all or any of the following hospitals –

Halifax General Hospital, Salterhebble, Halifax, West Yorkshire HX3 0PW,

Northowram Hospital, Northowram, Halifax, West Yorkshire HX3 7JW

Royal Halifax Infirmary, Free School Lane, Halifax, West Yorkshire HX1 2YP,

and at any other premises which are for the time being associated with any of those hospitals; and

(b)to manage community health services provided from all or any of the hospitals referred to in sub-paragraph (a) above and to provide the associated premises.”

Explanatory Note

(This note is not part of the Order)
This Order amends the Order which established the Calderdale Healthcare National Health Service Trust to alter the purpose for which the trust has been established, and to amend its functions. (The trust has, in exercise of its existing functions, assumed responsibility for the ownership and management of hospital accommodation and services provided at Halifax General Hospital, Salterhebble, Halifax HX3 0PW, for the management of community health services provided from Royal Halifax Infirmary, Free School Lane, Halifax, West Yorkshire HX1 2YP and for the ownership of associated premises. These services and accommodation were previously managed by the former Calderdale Health Authority.)
This Order confers on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990, to provide and manage hospitals or other establishments or facilities. It also alters the trust’s functions to enable it to provide hospital and community health services from premises not previously provided or managed by a Health Authority or a Special Health Authority, and so that the trust is no longer required to own the premises from which it is to provide such services.
