The Housing Renewal Grants (Prescribed Form and Particulars) (Amendment) Regulations 1997

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 2(2) and (4), 101(1) and 146(1) to (2) of the Housing Grants, Construction and Regeneration Act 1996(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Housing Renewal Grants (Prescribed Form and Particulars) (Amendment) Regulations 1997 and shall come into force on 14th April 1997.

Amendments

2.  The form set out in the Schedule to the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996(3) is amended as mentioned in the Schedule to these Regulations.

Application

3.  These Regulations shall not have effect in relation to applications for a grant made before 14th April 1997.

SCHEDULEAMENDMENTS TO THE FORM ENTITLED

“OWNER-OCCUPIER'S AND TENANT'S APPLICATIONS FORHOUSING RENEWAL GRANTS”

1.  For question 2B.1, substitute—

“47A.  “Child” and “young person” are defined by regulation 2(1) of the Housing Renewal Grants Regulations (S.I. 1996/2890) as follows:

“child”: a person under the age of 16;

“young person”: a person, other than someone who is in receipt of income support or is receiving advanced education (defined in the Income Support (General) Regulations 1987 (S.I. 1987/1967)), aged 16 or over but under 19 who is treated as a child for the purposes of section 142 of the Social Security Contributions and Benefits Act 1992.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the form, set out in the Schedule to the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996, to be used by owner-occupiers and tenants when applying for housing renewal grants under Chapter I of Part I of the Housing Grants, Construction and Regeneration Act 1996. Most of the amendments are consequential to amendments being made by the Housing Renewal Grants (Amendment) Regulations 1997 (S.I. 1997/977) to the Housing Renewal Grants Regulations 1996 (S.I. 1996/2890, amended by S.I. 1996/3119). There are also minor and drafting amendments.
Regulation 3 stops the Regulations applying to applications made before 14th April 1997.
