The Dual-Use and Related Goods (Export Control) (Amendment No. 2) Regulations 1997

The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the control of the export of goods and measures relating to trade in dual-use goods, in exercise of the powers conferred on him by that section hereby makes the following Regulations:

1.  These Regulations may be cited as the Dual-Use and Related Goods (Export Control) (Amendment No. 2) Regulations 1997 and shall come into force on 29th April 1997.

2.  At the end of the definition of “the Decision” in regulation 2 of the Dual-Use and Related Goods (Export Control) Regulations 1996(3) there shall be added the words—

“which was itself amended by Council Decision No. 97/100/CFSP of 20th January 1997(4)”

Explanatory Note

(This note is not part of the Regulations)
The Dual-Use and Related Goods Regulations 1996 contain references to Council Decision No. 94/942/CFSP of 19 December 1994 on the joint action adopted by the Council of the European Union on the basis of Article J. 3 of the Treaty on European Union concerning the control of exports of dual-use goods (O.J. No. L367, 31.12.94, p. 8), amended by Council Decision No. 96/613/CFSP (O.J. No. L 278, 30.10.96, p. 1).
Council Decision No. 96/613CFSP has now itself been amended by Council Decision No. 97/100/CFSP. These Regulations amend the 1996 Regulations so that references to the 1994 Decision are to that Decision as amended by the 1996 Decision as itself amended by the 1997 Decision.
