PROFESSIONS SUPPLEMENTARY TO MEDICINE

Whereas the Council for Professions Supplementary to Medicine has, in accordance with the provisions of section 10(1) of the Professions Supplementary to Medicine Act 1960(1), recommended to the Privy Council that the Act should extend to the profession of arts therapist:
And whereas a draft of this Order has been laid before Parliament and approved by resolution of each House:

Now, therefore, Their Lordships, in exercise of the powers conferred on Them by section 10(2) of the Act, and all other powers enabling Them in that behalf, after consulting, as boards appearing to Them to be concerned, all the boards established under the Act and existing on the day on which this Order is made, are pleased to order, and it is hereby ordered, as follows:—

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Professions Supplementary to Medicine (Arts Therapists Board) Order of Council 1997 and shall come into force on the day after the date on which it is made.

(2) In this Order, “the Act” means the Professions Supplementary to Medicine Act 1960.

Extension of application of the Act to the profession of arts therapist

2.  The Act shall have effect as if the profession of arts therapist were mentioned in section 1(2) of the Act, and accordingly the First Schedule to the Act (constitutions of the Council and boards, and supplementary provisions) shall have effect as if there were made the further alterations, additions or omissions specified in the Schedule to this Order.

SCHEDULEAlterations, Additions and Omissions in the First Schedule to the Act

1.  Part I of the First Schedule to the Act (Constitutions of the Council and Boards, and Supplementary Provisions) shall have effect as if—

(a)in paragraph 1(1), for “twenty-four” there were substituted “twenty-seven”;

(b)in paragraph 1(1)(b), for “five” there were substitued “seven” and for “two only shall be registered medical practitioners” there were substituted “three only shall be registered medical practitioners”;

(c)in paragraph 1(1)(c), for “eight” there were substituted “nine”;

(d)in paragraph 3(2), for “the professions of orthoptist and of prosthetist and orthotist” there were substituted “the professions of arts therapist, orthoptist, and prosthetist and orthotist”; and

(e)after paragraph 3(4) there were added the following sub-paragraph—

“(5) Before making an appointment under this paragraph as respects the profession of arts therapist the said Ministers shall consult the British Association of Art Therapists Limited, the Association of Professional Music Therapists and the British Association for Dramatherapists.”.

2.  Part II of the First Schedule to the Act (Constitution of the Boards) shall have effect as if—

(a)in the table at the end of paragraph 4(1)—

(i)in column (4) there were added after sub-column (f) a sub-column (g) with the heading “The Royal College of Psychiatrists”, with the symbol “—” in the entry for each existing board, and

(ii)above the line relating to membership of the Chiropodists Board there were inserted the following entries in relation to the Arts Therapists Board—

(b)after paragraph 7(4A) there were inserted the following sub-paragraph—

“(4B) Of the four members of the Arts Therapists Board appointed in pursuance of the said paragraph (d)—

(a)two shall be members of bodies which represent the interests of employers of arts therapists (or of the same such body);

(b)one shall be a member of a body which represents the interests of patients of arts therapists or of carers of such patients (or of both); and

(c)the other shall be a practitioner of a health or social care profession who appears to the Council to be qualified to advise the board on matters touching the practice of one or more of those professions, but who is not a registered medical practitioner or a person registered by any board.”;

(c)after paragraph 7(6) there were inserted the following sub-paragraph—

“(7) Without prejudice to the generality of sub-paragraph (5), before making any appointment to which sub-paragraph (4B) relates, the Council shall consult—

(a)in the case of an appointment to which paragraph (a) or paragraph (b) of sub-paragraph (4B) relates, any persons or bodies which appear to the Council, after it has consulted the Secretary of State, to represent the interests of employers of arts therapists (in the paragraph (a) case) or of patients of arts therapists and carers of such patients (in the paragraph (b) case); or

(b)in the case of an appointment to which paragraph (c) of sub-paragraph (4B) relates, any persons or bodies which appear to the Council, after it has consulted the Secretary of State, to be representative of practitioners referred to in that paragraph, or such of those persons or bodies as (having consulted the Secretary of State) it thinks fit.”; and

(d)in paragraph 8(3), for “(2), (3) or (4)” there were substituted “(2), (3), (4) or (5)”.

Explanatory Note

(This note is not part of the Order)
This Order extends the Professions Supplementary to Medicine Act 1960 to the profession of arts therapist. The Order has the effect, in consequence of that extension, of establishing the Arts Therapists Board. It makes amendments to that Act in relation to the composition of the Council for Professions Supplementary to Medicine, and makes specific provision in respect of the composition of the Arts Therapists Board.

1960 c. 66. The Act was extended to the profession of orthoptists by S.I.1966/990, and to the profession of prosthetists and orthotists by S.I. 1997/504; and ceased to extend to the profession of remedial gymnasts by virtue of S.I.1986/630. The First Schedule to the Act has effect as if amended by all three instruments.
