The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred on them by sections 2 and 3 of the Plant Health Act 1967(1) and now vested in them(2) and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement

1.  This Order may be cited as the Plant Health (Great Britain) (Amendment) Order 1997 and shall come into force on 1st May 1997.

Amendment of the Plant Health (Great Britain) Order 1993

2.—(1) The Plant Health (Great Britain) Order 1993(3) shall be amended in accordance with paragraphs (2) and (3) below.

(2) In Schedule 3, Part A, item 12, there shall be inserted in the second column after the words “third countries other than” the word “Algeria,”.

(3) In Schedule 16 there shall be inserted at the end the following—

“Commission Directive 97/14/EC”(4).

Explanatory Note

(This note is not part of the Order)
This Order amends the Plant Health (Great Britain) Order 1993 so as to implement Commission Directive 97/14/EC (OJ No. L 87, 2.4.97, p. 17.) amending Annex III to Council Directive 77/93/EEC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community.
The Order, which comes into force on 1st May 1997, adds Algeria to the list of third countries from which potatoes other than seed potatoes may be imported.
