The Secretary of State for Transport, in exercise of the powers conferred by sections 63 and 66 of the Road Traffic Act 1988(1) and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) Regulations 1997 and shall come into force on 30th June 1997.

2.—(1) The Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) (No. 2) Regulations 1996(2) shall be amended as follows.

(2) In regulation 7, for the words “1st July 1997” in the new regulation 18A(2) (obligatory certificates) to be inserted into the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982(3), there shall be substituted “1st January 1998”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) (No. 2) Regulations 1996, which in turn amend the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 by inserting a new regulation 18A into those Regulations.
Regulation 2 postpones the date appointed for the purposes of section 63(1) of the Road Traffic Act 1988 (“the 1988 Act”) from 1st July 1997 to 1st January 1998. The effect of this is twofold. Firstly it will be an offence, on or after 1st January 1998, to use a vehicle of a relevant class without the appropriate certificates in force under sections 54 to 58 of that Act. Secondly a licence under the Vehicle Excise and Registration Act 1994 will not be granted in respect of a vehicle to which regulation 18A applies unless, on the first application after 1st January 1998, evidence is produced that there is or are one or more certificates in force for the vehicle under sections 54 to 58 of the 1988 Act from which it appears that the vehicle complies with the prescribed type approval requirements.
