The Horizon National Health Service Trust (Establishment) Amendment (No. 2) Order 1997

The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, having completed the consultation prescribed under section 5(2) of that latter Act(3), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Horizon National Health Service Trust (Establishment) Amendment (No. 2) Order 1997 and shall come into force on 18th June 1997.

Amendment of NHS trust Establishment Order

2.  For Article 4 of the Horizon National Health Service Trust (Establishment) Order 1991(4) there shall be substituted:—

“Directors of the trust

4.  The trust shall have, in addition to the chairman—

(a)until 30th November 1997, 5 non-executive directors and 5 executive directors,

(b)on and after 1st December 1997, 4 non-executive directors and 4 executive directors.”

Explanatory Note

(This note is not part of the Order)
This Order further amends the constitution of an NHS trust established by Order under Part I of the National Health Service and Community Care Act 1990, by temporarily increasing the number of executive and non-executive directors from 4 to 5 until 30th November 1997.
The number of executive and non-executive directors was reduced from 5 to 4 by the Horizon National Health Service Trust (Establishment) Amendment Order 1997 (S.I. 1997/1376) with effect from 11th June 1997. As this Order is made to correct a defect in that Order, it is being issued free of charge to all known recipients of that Order.
