Explanatory Note

(This note is not part of the Order)
This Order prescribes substances other than oil, the threat of pollution from which (following a shipping casualty) triggers the Secretary of State’s powers of intervention under section 137 of the Merchant Shipping Act 1995 in accordance with section 138A of that Act.
The Order gives effect to the Protocol relating to Intervention on the High Seas in Cases of Marine Pollution by Substances other than Oil 1973 (Cmnd. 6038) (“the 1973 Protocol”).
The substances are listed in the Schedule. They are the substances enumerated in the Annex to the 1973 Protocol, as amended in 1997.

(1)
1995 c. 21; section 138A was inserted by the Merchant Shipping and Maritime Security Act 1997 (c. 28), section 3.
