The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities resulting from the establishment of the Lambeth Healthcare National Health Service Trust(2), having consulted that trust and the Special Trustees for St. Thomas' Hospital in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Lambeth Healthcare National Health Service Trust (Transfer of Trust Property) Order 1997 and shall come into force on 19th September 1997.

(2) In this Order—

“the Special Trustees” means the Special Trustees for St. Thomas' Hospital;

“the Trust” means the Lambeth Healthcare National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Special Trustees and the Trust on 3rd February 1997, which schedule has been signed on behalf of both the Special Trustees and the Trust.

Transfer of trust property

2.  On 19th September 1997 the trust property shall be transferred from the Special Trustees to the Trust.

Explanatory Note

(This note is not part of the Order)
This Order transfers to the Lambeth Healthcare National Health Service Trust on 19th September 1997 trust property formerly held by the Special Trustees for St. Thomas' Hospital. A copy of the schedule of trust property to which the Order refers can be obtained at the Department of Health, National Health Service Trust Unit, Quarry House, Quarry Hill, Leeds LS2 7UE.
