The Social Security (Recovery of Benefits) Act 1997 (Commencement) Order 1997

The Secretary of State for Social Security, in exercise of the power conferred upon her by section 34(2) of the Social Security (Recovery of Benefits) Act 1997(1), hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Social Security (Recovery of Benefits) Act 1997 (Commencement) Order 1997.

(2) In this Order, “the 1997 Act” means the Social Security (Recovery of Benefits) Act 1997.

Appointed days

2.—(1) The following provisions of the 1997 Act shall come into force on 3rd September 1997 for the purpose of conferring on the Secretary of State the powers to make regulations:

section 1(2) insofar as it relates to paragraphs 4 and 8 of Part I of Schedule 1

section 4(9)

section 11(5) and (6)

section 12(6) and (7)

section 13(3)

section 14(2), (3) and (4)

section 16(1) and (2)

section 18

section 19

section 21(3)

section 23(1), (2), (5) and (7).

(2) The 1997 Act to the extent it is not already in force shall come into force on 6th October 1997.

Explanatory Note

(This note is not part of the Order)
This Order brings into force on 3rd September 1997 specified provisions of the Social Security (Recovery of Benefits) Act 1997 for the purpose of enabling the Secretary of State to make regulations (article 2(1)).
The whole Act, to the extent it is not already in force, is brought into force on 6th October 1997 (article 2(2)).
