In exercise of the powers conferred upon the Secretary of State by sections 484 and 569(4) of the Education Act 1996(1) the Secretary of State for Education and Employment hereby makes the following Regulations:

1.  These Regulations may be cited as the Education (Grants for Education Support and Training) (England) (Amendment) Regulations 1997 and shall come into force on 1st October 1997.

2.  The Education (Grants for Education Support and Training) (England) Regulations 1997(2) shall be amended as follows.

3.  In regulation 2 after paragraph (2) there shall be inserted the following paragraph—

“(3) The purposes specified in paragraphs 13 and 16 of the Schedule are without prejudice to the generality of the purpose specified in paragraph 20 of the Schedule.”

4.  In regulation 5 for paragraph (2) there shall be substituted the following paragraph—

“(2) Grants in respect of approved expenditure incurred by an education authority on or after 1st April 1997 in respect of items referred to in the paragraphs of the Schedule listed in the left hand column of the table below shall be payable at the percentage rate of such expenditure specified in relation thereto in the right hand column of the table.

5.  In regulation 6(4) the words “but not exceeding three-quarters of the grant applied for in respect of that expenditure” shall be omitted.

6.  In the Schedule after paragraph 19 there shall be inserted the following paragraphs—

“20.  The improvement, renovation or replacement of buildings used for educational purposes and the provision of equipment (including information technology) for educational purposes.

21.—(a) The education of children who are under the age of five years or who have reached that age but have not yet begun the school term following their fifth birthday, together with care provided for such children in connection with their education; and

(b)the training of persons in the provision of such education and care.

22.—(a) Steps to be taken in preparation for the publication of information relating to the performance of pupils at primary schools pursuant to any requirement to publish such information which may be prescribed by regulations under section 537(6)(c) of the 1996 Act;

(b)the publication of information about primary schools maintained by the education authority and the performance of pupils at such schools other than information which is required to be published by or under any provision of the 1996 Act; and

(c)measures other than any which may be prescribed by regulations under section 537(6)(c) of the 1996 Act to bring the information referred to in sub-paragraph (a) to the attention of the local community.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Education (Grants for Education Support and Training) (England) Regulations 1997.
Apart from making a drafting amendment they add three new purposes (items 20 to 22 in the Schedule) for which grant is payable at a rate of 100% of approved expenditure and remove the restriction contained in regulation 6(4) that the immediate payment of grant in the last period of the financial year cannot exceed 75% of the grant applied for.
