The Licensing (Fees) (Variation) Order 1997

The Secretary of State, in exercise of the powers conferred on him by sections 29(1) and 198(2) of the Licensing Act 1964(1), hereby makes the following Order:

1.  This Order may be cited as the Licensing (Fees) (Variation) Order 1997 and shall come into force on 1st January 1998.

2.—(1) The Schedule to the Licensing (Fees) Order 1978(2) shall be varied by substituting—

(a)for “£12.50”, in each place where it occurs, “£30.00”;

(b)for“£10.00”, in each place where it occurs, “£25.00”;

(c)for “£6.50”, in each place where it occurs, “£16.00”;

(d)for “£4.00”, in each place where it occurs, “£10.00”; and

(e)for “£2.00”, in each place where it occurs, “£5.00”.

(2) In the Schedule to the Licensing (Fees) Order 1978, the entry “grant or renewal of a certificate of suitability — s. 79”, together with its fee, shall be omitted.

3.  Article 2 of the Licensing (Fees) Order 1983(3) shall be varied by substituting for “£4.00”, in each place where it occurs, “£10.00”.

4.  The Licensing (Fees) (Variation) Order 1980(4) is hereby revoked.

Explanatory Note

(This note is not part of the Order)
Article 2(1) of this Order substitutes new fees for the various fees chargeable by justices' clerks under the Schedule to the Licensing (Fees) Order 1978 in respect of matters arising under the Licensing Act 1964. Article 2(2) omits an entry from that Schedule consequent on amendments to section 79 of that Act which removed the jurisdiction of justices. Article 3 increases the fee under the Licensing (Fees) Order 1983 on the grant of an occasional permission under section 1 of the Licensing (Occasional Permissions) Act 1983.
