The Department of Economic Development, being the Department concerned(1), in exercise of the powers conferred on it by Articles 40(2) and (3) and 55(2) of the Health and Safety at Work (Northern Ireland) Order 1978(2) and of every other power enabling it in that behalf, after consultation in accordance with Article 46(1) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to the Department to be appropriate, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Health and Safety (Petroleum-Spirit Licence Fees) Regulations (Northern Ireland) 1997 and shall come into operation on 3rd March 1997.

Fees

2.  The fee payable under each provision specified in column 1 of the Schedule for the purpose described in the corresponding entry in column 2 shall be that specified in the corresponding entry in column 3.

Date from which petroleum-spirit licence fees are payable

3.  Notwithstanding the provisions of section 4 of the Petroleum (Consolidation) Act (Northern Ireland) 1929(3) or section 1(4) of the Petroleum (Transfer of Licences) Act (Northern Ireland) 1937(4), the fees specified in the Schedule shall be payable for any petroleum-spirit licence first having effect or any transfer or renewal of a licence first taking effect on or after the date of the coming into operation of these Regulations irrespective of the date of the application for that licence, transfer or renewal.

Revocation

4.  The Health and Safety (Petroleum-Spirit Licence Fees) Regulations (Northern Ireland) 1995(5) are hereby revoked.

Fee

1.
In the case of a solid substance for which by virtue of an Order in Council or order made under section 19 of the Petroleum (Consolidation) Act (Northern Ireland) 1929 a licence is required, the fee payable under this Schedule shall be calculated as if one kilogram of the substance were equivalent to one litre.

2.
The fee payable for a licence of more or less than one year’s duration shall be the fee set out above increased or decreased, as the case may be, proportionately according to the duration of the period for which the licence is granted or renewed.

Explanatory Note

(This note is not part of the Regulations.)
These Regulations fix the fees payable for the grant, renewal or transfer of a petroleum-spirit licence. The new fees compared with those fixed by the Health and Safety (Petroleum-Spirit Licence Fees) Regulations (Northern Ireland) 1995 are as set out below:
