ROAD TRAFFIC AND VEHICLES
Prohibition of Traffic (Causeway End Road, Unclassified No. 41, Lisburn) Order (Northern Ireland) 1997

WHEREAS the Department of the Environment is satisfied that part of Causeway End Road, Lisburn, is unsuitable for unrestricted use by motor vehicles;
AND WHEREAS the Department has published a notice in compliance with Article 23(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1);
AND WHEREAS no objection or representation has been received;

NOW THEREFORE the Department, in exercise of the powers conferred on it by Article 22(1) of the Road Traffic (Northern Ireland) Order 1981 and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Prohibition of Traffic (Causeway End Road, Unclassified No. 41, Lisburn) Order (Northern Ireland) 1997 and shall come into operation on 24th March 1997.

Prohibition

2.  Subject to Article 3, the use by motor vehicles of Causeway End Road, Unclassified No. 41, Lisburn, from its junction with Knockmore Road, Route A520, to its junction with Causeway End Park, Unclassified No. 7005, is prohibited.

Exceptions

3.  Article 2 shall not apply—

(a)to a motor vehicle being used for the purposes specified in the Schedule;

(b)to a motor vehicle the driver of which is acting upon the direction or with the permission of a constable in uniform or of a traffic warden.

Article 3

SCHEDULEMOTOR VEHICLES EXCEPTED FROM THE PROHIBITION IN ARTICLE 2

1.  A motor vehicle being used for access to premises situated on or adjacent to the length of road.

2.  A motor vehicle being used for police, military, ambulance or fire brigade purposes or in an emergency by a medical practitioner.

3.  A motor vehicle being used on or adjacent to the length of road in pursuance of statutory powers and duties by or on behalf of a government department, district council or statutory undertaker.

4.  A motor vehicle being used in connection with the laying, erection, alteration or repair of any telecommunication apparatus as defined in section 4(3) of the Telecommunications Act 1984(2).

5.  A motor vehicle being used for the purpose of delivering or collecting postal packets.

6.  A motor vehicle being used for the conveyance of goods to or from premises situated on or adjacent to the length of road, being goods which by reason of their size or weight could not reasonably be conveyed to or from such premises otherwise than by means of a motor vehicle and provided always that the motor vehicle shall not be permitted to use the length of road for any longer period than may be necessary for the conveyance, loading or unloading of those goods.

7.  A motor vehicle being used in connection with a funeral from a dwellinghouse on or adjacent to the length of road.

8.  A motor vehicle being used in connection with any building operation or demolition on or adjacent to the length of road.

Explanatory Note

(This note is not part of the Order.)
This Order prohibits the use of Causeway End Road, Unclassified No. 41, Lisburn, from its junction with Knockmore Road, Route A520, to its junction with Causeway End Park, Unclassified No. 7007, by motor vehicles.
Exceptions include motor vehicles being used for access to premises situated on or adjacent to the length of road, emergency motor vehicles, motor vehicles being used on or adjacent to the length of road in pursuance of statutory powers and duties, motor vehicles being used in connection with telecommunications work, building or demolition operations, funerals, or the delivery or collection of postal packets and motor vehicles being used for the conveyance of goods in certain circumstances.
Any person who acts in contravention of the Order shall be guilty of an offence under the Road Traffic (Northern Ireland) Order 1981 and shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale (£1,000).
Traffic signs indicating the effect of the Order will in due course be erected on the road.
