The Secretary of State, in exercise of the powers conferred on him by sections 1(1) and (2) and 24(1) and (3) of the Food and Environment Protection Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Partial Revocation Order 1997 and shall come into force on 22nd January 1997.

(2) In this Order, “the principal Order” means the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991(2).

Partial revocation

2.—(1) The principal Order is revoked so far as it designates any part of the areas set out in Schedule 1 to this Order.

(2) Part II of Schedule 1 to the principal Order shall be amended in accordance with Schedule 2 to this Order.

Article 2(1)
SCHEDULE 1

Dumfries and Galloway Region

1.  The area of land within Stewartry District comprising that part of the Parish of Dunscore bounded as follows:–

On the north at Loch Urr on the boundary between Stewartry and Nithsdale Districts running in an easterly direction along the boundary between the Parishes of Glencairn and Dunscore until the minor road north of Craigenvey Moor and then further east along the said minor road until the point national grid reference NX782846; then in a south easterly direction following the dyke to the point national grid reference NX788842; then in a south westerly direction to the Carstramon Hill; then in a westerly direction until the watercourse to the north of Craigenputtock Moor; then following the said watercourse in a westerly direction until it meets the Urr Water; then in a northerly direction following the Urr Water to Loch Urr.

Central Region

2.  The area of land within Stirling District comprising that part of the Parish of Balquhidder bounded as follows:–

On the north from the point national grid reference NN618230 continuing in a southerly direction by the boundary between Central Region and Tayside Region until it meets the boundary between the Parishes of Balquhidder and Callander; then continuing in a south-westerly direction by said Parish boundary until it meets the Strathyre Plantation; then in a northerly direction by the eastern boundary of said plantation to the point national grid reference NN578200; then continuing in an easterly direction to the Burn of Ample and then in a northerly direction by said burn until it meets the minor road at Falls of Edinample; then in an easterly direction by said road to the point national grid reference NN618230.

Article 2(2)
SCHEDULE 2

1.  For paragraph 1(c) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

“(c)The area of land within the former Wigtown District, now Dumfries and Galloway Council area, comprising that part of the Parish of Minnigaff bounded as follows:–

On the north-west from the point of intersection between the Cross Burn and the northern boundary between the Dumfries and Galloway Council area and South Ayrshire Council area (formerly the boundary between Dumfries and Galloway Region and Strathclyde Region) in an easterly direction following said boundary and the boundary between Dumfries and Galloway Council area and East Ayrshire Council area until it meets the former boundary between Wigtown District and Stewartry District at the point national grid reference NX467873; then in a southerly direction following the western boundary of the unnamed forestry plantation and the boundary between the former Wigtown District and Stewartry District to point national grid reference NX476816; then in a generally westerly, northerly, and southerly direction following the eastern, northern and western boundaries of Ellergower Knowe Plantation until it meets Loch Dee; then following the northern, western and southern banks of Loch Dee to the White Laggan Burn; then following the line of the said Burn in a southerly direction to point national grid reference NX458761; then in a southerly direction to the point of intersection with the Stronbae Hill Plantation at point national grid reference NX458756; then following the boundary of the said Plantation in a southerly then westerly, then northerly direction to the point national grid reference NX450764; then in a north-easterly direction to spot height 674 on Curleywee; then in a north-westerly direction to point national grid reference NX446788 on the Glenhead Burn; then in a westerly direction following the line of the said Burn to the point of intersection with the Glentrool Forest; then in a north-westerly and westerly direction following the north-eastern boundary of Glentrool Forest to the east bank of Loch Trool at point national grid reference NX422800, then in a generally westerly direction following the east and north banks of Loch Trool to point national grid reference NX409800; then following the eastern boundary of Glentrool Forest in a generally northerly, westerly, southerly and again northerly direction to the point of intersection between the Cross Burn and the northern boundary of Dumfries and Galloway Council area with South Ayrshire Council area;”.

2.  For paragraph 2(c) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

“(c)The area of land within the former Cumnock and Doon Valley District, now East Ayrshire Council area, comprising that part of the Parish of Auchinleck bounded as follows:–

On the north on the boundary between the Parishes of Muirkirk and Auchinleck at spot height 418 at point national grid reference NS675224; then continuing generally in an easterly direction along said boundary until it meets the western boundary of Drummond’s Knowe Plantation; then following the western boundary of the said Plantation in a south-westerly direction until it meets the boundary between the Parishes of Auchinleck and New Cumnock; then continuing in a westerly direction by the said boundary and the boundary between the Parishes of Auchinleck and Old Cumnock to the point national grid reference NS636195; and continuing in a northerly direction to the point national grid reference NS636198; then continuing in a westerly direction to the small plantation at point national gird reference NS633198 and then continuing by the eastern and northern boundaries of the small plantation to the point national grid reference NS634202; and then in a north-westerly direction to the point national grid reference NS629215; then in a north-easterly direction to the Glass Water at point national grid reference NS637227; then in a generally south-easterly direction following the said Glass Water to the point national grid reference NS646224; then in a north-easterly direction to the point national grid reference NS650225; then in an easterly direction to spot height 418 at point national grid reference NS675224.”.

3.—(a) In paragraph 2(d) of Part II of Schedule 1 to the principal Order there shall be substituted for the words “Cumnock and Doon Valley District” where they first appear the words “former Cumnock and Doon Valley District, now East Ayrshire Council area”.

(b)For paragraph 2(d)(ii) and (iii) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

“(ii)on the north from the summit of Bibblon Hill at point national grid reference NS665324 in an easterly direction following the boundary between East Ayrshire Council area and South Lanarkshire Council area to the point national grid reference NS718342; then in a south westerly direction to point national grid reference NS711320; then continuing in a south westerly direction to point national grid reference NS705315; then in a southerly direction to point national grid reference NS705310; then in a south-westerly direction to the Road A723 at point national grid reference NS697307; then in a northerly direction following the line of the said Road to spot height 297; then in a westerly direction to spot height 466 on Middlefield Law; then continuing in a westerly direction to point national grid reference NS665304; then in a northerly direction to point national grid reference NS663315; then in a northerly direction to the summit of Bibblon Hill at point national grid reference NS665324;

(iii)on the north from the point national grid reference NS667259 on the River Ayr at the intersection with the March Burn in an easterly direction following the line of the said River to the intersection with Crossflat Farm road at point national grid reference NS705275; then in a south-easterly direction following said road to Crossflat Farm to the disused railway line; then in a south-westerly direction, following the line of the said disused railway line, to the point of intersection with an unnamed burn at the point national grid reference NS701268; then in a south-easterly direction following the line of the said burn to the point national grid reference NS704260; then in a south-easterly direction to the summit of The Steel at spot height 413; then in a south-easterly direction to point national grid reference NS725244 on Muirkirk Parish boundary; then in a southerly direction, following the line of said boundary, to the point of intersection with the boundary between the Parishes of Muirkirk and Auchinleck; then in a north-westerly direction, following the line of the boundary between said Parishes to the point national grid reference NS654235; then in a north-easterly direction to the source of the March Burn; then in a north-easterly direction following the said Burn to the intersection with the River Ayr.”.

4.  For paragraph 2(o) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

“(o)The area of land within the former Eastwood District, now East Renfrewshire Council area, comprising that part of the Parish of Eaglesham bounded as follows:–

On the north-west at Soame Bridge on the Road B764; continuing in a north-easterly direction along said Road to the point national grid reference NS553508; then continuing in a south-westerly direction to the point national grid reference NS547501; and then continuing generally in an easterly direction by the Dunwan Burn to the point national grid reference NS569498; and then generally in a southerly direction to the point national grid reference NS572488 and on to the point national grid reference NS572477 on the Carrot Burn; then north-easterly along the Carrot Burn to the point national grid reference NS577481 and continuing in the same general direction to the point national grid reference NS585482 and to the point national grid reference NS593491; then in a south easterly direction to the point national grid reference NS595490; then continuing in a southerly direction to the point national grid reference NS596484 and in a south-easterly direction to the point national grid reference NS604482; then continuing in a generally south-westerly and north-westerly direction following the Eaglesham Parish boundary with the Parishes of East Kilbride, Galston and Fenwick, to the point of intersection with Soame Bridge on the Road B764.”.

5.  For paragraph 3(a) of Part II of Schedule 1 to the principal Order there shall be substituted the following:–

“(a)The area of land within the former Stirling District now Stirling Council area comprising that part of the Parish of Killin bounded as follows:–

On the north from the point national grid reference NN509369 on the River Lochay in a south-easterly direction along the River Lochay to the point of intersection with the Minor Road at the bridge at point national grid reference NN544348; then continuing generally south-easterly following the line of said Road to the point of intersection with the Monemore Plantation at point national grid reference NN570340; then to, and continuing generally in a southerly direction along, the western boundary of the Monemore Plantation to the southernmost corner of said Plantation; then in a south-easterly direction to the River Dochart; then in a south-westerly direction, following the line of the said River Dochart, to the point of intersection with an unnamed burn at the point national grid reference NN508287; then in a south-easterly direction following the line of said unnamed burn to the point of intersection with the Road A85; then in a north-easterly direction, following the line of said Road, to the point of intersection with the boundary between the Parishes of Killin and Balquhidder; then continuing in a westerly direction by said boundary to the point national grid reference NN470250; then continuing in a north-westerly direction to the south-eastern corner of the Meall Thairbh Plantation; then continuing north following the Allt Coire Chaorach Burn until it meets the River Dochart; then in a westerly direction along the River Dochart to the point where it joins the Allt Riobain Burn; then in a northerly direction following said Burn to point national grid reference NN454322; then in a north easterly direction to the summit of Meall a Churain at spot height 917; then in a north-easterly direction to the summit at spot height 881; then in an easterly direction to the summit at spot height 864; then in a south-easterly direction to the summit at spot height 766; then continuing generally in a northerly direction to and by the Allt Dubhchlair Burn until it meets the River Lochay at the point national grid reference NN509369.”.

Explanatory Note

(This note is not part of the Order)
This Order partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991 which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been, or which may have been, rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.
This Order reduces the area subject to restriction.
