The Magistrates' Courts Fees (Amendment) Order (Northern Ireland) 1997

The Lord Chancellor, in exercise of the powers conferred on him by section 116(1) of the Judicature (Northern Ireland) Act 1978(1), after consultation with the Lord Chief Justice and with the concurrence of the Treasury, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Magistrates' Courts Fees (Amendment) Order (Northern Ireland) 1997 and shall come into operation on 1st April 1997.

Interpretation

2.  In this Order, “the 1996 Order” means the Magistrates' Courts Fees Order (Northern Ireland) 1996(2).

3.  For Section D in Schedule 1 to the 1996 Order there shall be substituted the new Section D set out in Schedule 1 to this Order.

4.  In Section E in Schedule 1 to the 1996 Order after fee No. 24 there shall be inserted the following new fee:—

“24A.  Application for temporary continuance of business in other premises under Article 26 ... ... ... ...£30·00”

5.  For Section F in Schedule 1 to the 1996 Order there shall be substituted the new Section F set out in Schedule 2 to this Order.

6.  In Section G in Schedule 1 to the 1996 Order for the amount of £10·00, payable in respect of Fee No. 52, there shall be substituted the amount of £12·00.

Explanatory Note

(This note is not part of the Order.)
This Order amends the Magistrates' Courts Fees Order (Northern Ireland) 1996 to

prescribe the fees to be taken in respect of certain applications under the Licensing (Northern Ireland) Order 1996 and the Registration of Clubs (Northern Ireland) Order 1996;

prescribe the fee to be taken in respect of an application for an order authorising the continuance of a business in other premises under Article 26 of the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985; and

increase the fee to be taken in respect of a notice of application to a magistrates' court (other than an application under Article 91(3) or (4) of the Magistrates' Courts (Northern Ireland) Order 1981) not otherwise provided for.
