The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by paragraph 12 of Schedule 5 to the Gas Act 1995(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Gas Act 1995 (Rateable Values) (Modification) Order 1997 and shall come into force on 3rd March 1997.

Modifications of rateable value

2.—(1) The British Gas plc (Rateable Values) Order 1994(2) is modified as follows.

(2) With effect from 1st April 1996, in article 2 (interpretation), in the definition of “the standard formula”, for paragraph (a) there is substituted—

“(a)T in respect of English gas hereditaments is £478,731,900 and in respect of Welsh gas hereditaments is £28,676,000;”.

(3) With effect from 1st March 1996, article 5 (rateable values) has effect as if in paragraph (a) for “£483,887,500” there were substituted “£478,731,900” and for “£29,373,300” there were substituted “£28,676,000”.

Explanatory Note

(This note is not part of the Order)
Gas hereditaments occupied (or, if unoccupied, owned) by British Gas plc (“British Gas”) are required to be shown in the central rating lists compiled on 1st April 1995 by virtue of the Central Rating Lists Regulations 1994 (S.I. 1994/3121). The rateable value of those hereditaments is specified in the British Gas plc (Rateable Values) Order 1994. Different rateable values are specified for hereditaments in England and for hereditaments in Wales, and the amount is adjusted from year to year by reference to changes in the length of certain pipe-lines.
Schedule 5 to the Gas Act 1995 provides for the transfer to a nominated associate of British Gas of such property of British Gas as is allocated to that associate by a scheme. The transfer took place on 1st March 1996, the appointed day for the purposes of the 1995 Act by virtue of S.I. 1996/218.
This Order modifies, with effect from 1st March 1996, the rateable values of gas hereditaments retained by British Gas following that transfer. By virtue of this Order, with effect from 1st April 1996 the amount of the rateable value of gas hereditaments occupied or owned by British Gas by reference to which the adjustment formula is applied will be reduced. The adjustment formula remains otherwise unchanged.
