The Department of Economic Development, being the Department concerned(1), in exercise of the powers conferred on it by Article 40(2) and (4) of the Health and Safety at Work (Northern Ireland) Order 1978(2) and of every other power enabling it in that behalf, after consultation in accordance with Article 46(1) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appear to it to be appropriate, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Health and Safety (Miscellaneous Fees Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 16th June 1997.

Amendment of the Asbestos (Licensing) Regulations (Northern Ireland) 1984

2.  In regulation 4(6) of the Asbestos (Licensing) Regulations (Northern Ireland) 1984(3) for the sum “£505” there shall be substituted “£362”.

Amendment of the Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) Regulations (Northern Ireland) 1992

3.  In each of the regulations 6(2)(c) and 6(5)(b) of the Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) Regulations (Northern Ireland) 1992(4) for the sum “£2·50” there shall continue to be substituted “£2·70”.

Amendment of the Notification of New Substances Regulations (Northern Ireland) 1994

4.  For Schedule 4 to the Notification of New Substances Regulations (Northern Ireland) 1994(5) there shall continue to be substituted the Schedule set out in the Schedule to these Regulations.

Amendment of the Genetically Modified Organisms (Contained Use) Regulations (Northern Ireland) 1994

5.  For regulation 22 of the Genetically Modified Organisms (Contained Use) Regulations (Northern Ireland) 1994(6) there shall be substituted—

“Fees for notifications

22.—(1) Fees shall be payable in accordance with paragraph (2) by a notifier to the Department in relation to any matter referred to in that paragraph.

(2) The fees referred to in paragraph (1) shall be—

(a)subject to sub-paragraph (b), on each notification of the intention to use premises for activities involving genetic modification for the first time under regulation 8, £54·50;

(b)on each notification of the intention to use premises for activities involving genetic modification for the first time, where a consent is required under regulation 8(3), £58·90;

(c)subject to sub-paragraph (d), on each notification of individual activities involving genetic modification under regulation 9, £62.40;

(d)on each notification of individual activities involving genetic modification for which a consent is required under regulation 9(5), £120·20;

(3) This regulation shall not apply to any notification made for the purposes of regulation 24(1) or (3) (which relates to transitional provisions).”.

Revocations

6.  The Asbestos (Licensing) (Fees Amendment) Regulations (Northern Ireland) 1994(7) and the Health and Safety (Miscellaneous Fees Amendment) Regulations (Northern Ireland) 1996(8) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations.)

1.  These Regulations—

(a)amend the Asbestos (Licensing) Regulations (Northern Ireland) 1984 so as to reduce the fee payable to the Department of Economic Development by an applicant for a licence under regulation 4 of those Regulations for work with asbestos insulation or asbestos coating (regulation 2);

(b)re-enact, without change in the rate of fee, the amendment of the Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) Regulations (Northern Ireland) 1992 made by regulation 2 of the Health and Safety (Miscellaneous Fees Amendment) Regulations (Northern Ireland) 1996 (“the 1996 Amendment Regulations”) which are revoked by these Regulations (regulations 3 and 6);

(c)re-enact, without change in the rate of fee, the amendment of the Notification of New Substances Regulations (Northern Ireland) 1994 made by regulation 3 of the 1996 Amendment Regulations which are revoked by these Regulations (regulations 4 and 6);

(d)amend the Genetically Modified Organisms (Contained Use) Regulations (Northern Ireland) 1994 so as to reduce the fees payable by a notifier to the Department of Economic Development in relation to the notification of the use of premises for activities involving genetic modification, and of individual activities involving genetic modification (regulation 5).

2.  Where these Regulations reduce the fees previously fixed by the Regulations set out in paragraph 1, the details of those reductions are set out below:—

3.  The Regulations revoke the Asbestos (Licensing) (Fees Amendment) Regulations (Northern Ireland) 1994 in addition to the 1996 Amendment Regulations.

4.  An estimate of the savings associated with these Regulations has been prepared by the Department of Economic Development and is held at that Department’s offices at 83 Ladas Drive, Belfast, BT6 9FJ, from where a copy may be obtained on request.
