The Department of Agriculture, in exercise of the powers conferred on it by Articles 2(3), 5(1), 19(b), (e), (f), (i) and (k), 29(1) and (2), 32, 44, 46(7A) and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Specified Bovine Material (No. 2) (Amendment No. 2) Order (Northern Ireland) 1996 and shall come into operation on 8th January 1997.

Amendment to the Specified Bovine Material (No. 2) Order (Northern Ireland) 1996

2.  The Specified Bovine Material (No. 2) Order (Northern Ireland) 1996(2) shall be amended in accordance with Articles 3 and 4.

3.  In Article 2(1) (Interpretation) for the definition of “scheme animal” there shall be substituted the following definition—

“ “scheme animal” means a bovine animal—

(a)
which has been slaughtered pursuant to the purchase, slaughter and disposal scheme introduced under Commission Regulation (EC) No. 716/96(3) adopting exceptional support measures for the beef market in the United Kingdom;

(b)
which, being an animal which has been exposed to the infection of bovine spongiform encephalopathy, the Department has caused to be slaughtered in accordance with the provisions of paragraph 10A of Part I of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981(4);”.

4.  Article 4 (prohibition on sale, supply and use of certain feedingstuffs for feeding to animals and poultry) shall be amended by inserting in paragraph (8)(a) after the words “United Kingdom” the words “or to a working dog”.

Explanatory Note

(This note is not part of the Order.)
This Order amends the definition of “scheme animal” in Article 2(1) of the Specified Bovine Material Order (Northern Ireland) 1996 (“the principal Order”) so that the various requirements of that Order regarding the separation of specified bovine material and other animal parts which are already disapplied in relation to the carcases of animals slaughtered pursuant to the purchase scheme introduced under Commission Regulation (EC) No. 716/96, are now similarly disapplied in relation to the carcases of animals slaughtered in accordance with the provisions of paragraph 12A of Part I of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981 as animals exposed to the infection of bovine spongiform encephalopathy (Article 3).
The Order also makes a minor technical amendment to Article 4 of the principal Order in respect of the possession of mammalian meat and bone meal, any product thereof or anything containing mammalian meat and bone meal (Article 4).
