The Secretary of State, in exercise of the powers conferred on him by section 9(2) of, and paragraph 4(2)(b) of Schedule 1 to, the European Parliamentary Elections Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the European Parliamentary Elections (Returning Officers) (Scotland) Order 1996 and shall come into force on 1st April 1996.

(2) In this Order—

“local authority” means a council constituted under section 2 of the Local Government etc. (Scotland) Act 1994;

“local government area” means the area of a local authority; and

references to European Parliamentary constituencies are references to the European Parliamentary constituencies established by the European Parliamentary Constituencies (Scotland) Order 1984(2).

Returning Officers

2.  In the case of each of the European Parliamentary Constituencies named in the first column of the Schedule to this Order, being constituencies situated in more than one local government area, the returning officer for an European Parliamentary Election shall be the person who, under section 41 of the Representation of the People Act 1983(3), is, or may discharge the functions of, the returning officer at elections of councillors for the local authority for the local government area named opposite thereto in the second column of the said Schedule.

Revocation

3.  The European Parliamentary Elections (Returning Officers) (Scotland) Order 1984(4) is hereby revoked.

Explanatory Note

(This note is not part of the Order)
This Order is consequential on the reorganisation of local government in Scotland and directs who shall be the returning officer for an European Parliamentary election in the case of those European Parliamentary constituencies in Scotland which are situated in more than one of the local government areas established by the Local Government etc. (Scotland) Act 1994 (c. 39). The Order comes into force on 1st April 1996 being the date on which the new local government areas are to have effect in Scotland.
The European Parliamentary Elections (Returning Officers) (Scotland) Order 1984 (S.I. 1984/623), by which returning officers are at present designated for European Parliamentary constituencies which are situated in more than one region or islands area, is revoked.
