The Secretary of State for Health, in exercise of powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Walton Centre for Neurology and Neurosurgery National Health Service Trust (Establishment) Amendment Order 1996, and shall come into force on 6th April 1996.

Amendment of Establishment Order

2.  In Article 3 of the Walton Centre for Neurology and Neurosurgery National Health Service Trust (Establishment) Order 1991(3) (functions of the trust)—

(a)in paragraph (1) for “section 5(1)(a)” there shall be substituted “section 5(1)(b)”; and

(b)for paragraph (2) there shall be substituted the following new paragraph:—

“2.  The trust’s functions shall be to provide and manage hospital services at either or both of the following hospitals—

(a)Walton Hospital, Rice Lane, Liverpool L9 1AE, and

(b)Longmore Lane, Fazakerley, Liverpool L9 7AL,

and at any other hospital which is associated with either of the above hospitals.”

Explanatory Note

(This note is not part of the Order)
This Order amends the Order which established the Walton Centre for Neurology and Neurosurgery National Health Trust, to alter the purpose for which the trust was established, and to amend is functions. (The Trust has, in exercise of its existing functions, assumed responsibility for the ownership and management of the Walton Hospital, Liverpool and associated hospitals, previously managed by the former South Sefton Health Authority.) This Order confers on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990, to provide and manage hospitals or other establishments or facilities. It also alters the trust’s functions so that they are no longer confined to ownership and management of establishments or facilities previously managed or provided by health authorities, but include the provision and management of accommodation and services at other premises.
