The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 16(1) and (8) and 36 of the Plant Varieties and Seeds Act 1964(1) and now vested in them(2) and of all other powers enabling them in that behalf, after consultation in accordance with the said section 16(1) with representatives of such interests as appear to them to be concerned, hereby make the following Regulations:

Title and commencement

1.  These Regulations may be cited as the Vegetable Seeds (Amendment) Regulations 1996 and shall come into force on 1st July 1996.

Amendment of the Vegetable Seeds Regulations 1993

2.—(1) The Vegetable Seeds Regulations 1993(2) shall be amended in accordance with the provisions of this regulation.

(2) In the table in paragraph 8 of Part I of Schedule 5 (sampling of seed lots) there shall be added at the end the following new line—

“20,001 kg and above

one primary sample for each 700 kg but not less than 40”.

(3) In the table in Part II of Schedule 5 (maximum weight of a seed lot and minimum weight of a submitted sample) there shall be substituted for the figure “20” in the columns headed “Maximum lot weight (tonnes)” opposite the entries “Broad bean”, “French bean” and “Pea” in the columns headed “Kind”the figure “25”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations, which come into force on 1st July 1996, amend the Vegetable Seeds Regulations 1993 so as to implement Commission Directive 96/18/EC (OJ No. L76, 26.3.96, p.21) amending various Council Directives on the marketing of seeds and propagating materials. The maximum seed lot weight for seeds of broad bean, French bean and pea is increased to 25 tonnes.
These Regulations also make provision for the minimum requirements in respect of primary sampling of seed lots of 20,001 kg and above.
