The Minister of Agriculture, Fisheries and Food, in exercise of the powers conferred on him by section 98 of the Environment Act 1995(1) and of all other powers enabling him in that behalf, with the consent of the Treasury and after consulting the Secretary of State, the Countryside Commission, the Nature Conservancy Council for England and the Historic Buildings and Monuments Commission for England in accordance with section 99 of that Act, hereby makes the following Regulations—

Title, commencement and extent

1.—(1) These Regulations may be cited as the Countryside Stewardship (Amendment) (Extension to the Isles of Scilly) Regulations 1996 and shall come into force on 30th June 1996.

(2) These Regulations extend to England(2).

Amendment of previous Regulations

2.  For paragraph (2) of regulation 1 (title, commencement and extent) of the Countryside Stewardship Regulations 1996(3), there shall be substituted the following—

“(2) These Regulations extend to England, including the Isles of Scilly.”.

Explanatory Note

(This note is not part of the Regulations)
The Regulations amend the Countryside Stewardship Regulations 1996 (S.I. 1996/695) (“the principal Regulations”) which supplement Council Regulation (EEC) No. 2078/92 (OJ L 215, 30.7.92, p. 85) on agricultural methods compatible with the requirements of the protection of the environment and the maintenance of the countryside.
The Regulations extend the principal Regulations to the Isles of Scilly (regulation 2). The principal Regulations were made under section 98 of the Environment Act on 8th March 1996, came into force on 1 April 1996 and extend to England. Under section 117 of the Environment Act 1995, certain sections of the Act, including sections 98 and 99, do not apply in relation to the Isles of Scilly unless an Order is made under section 117(3) applying a provision of the Act in relation to the Isles of Scilly. At the time the principal Regulations were made, no such Order had been made in relation to section 98 or 99 of the Environment Act 1995.
The Environment Act 1995 (Isles of Scilly) Order 1996 (S.I. 1996/1030), which was made on 2nd April 1996 and came into force on 1st May 1996, applied sections 98 and 99 of the Environment Act 1995 to the Isles of Scilly.
No Compliance Cost Assessment in relation to these Regulations has been prepared.
