The Secretary of State, in exercise of the powers conferred on him by section 101 of the Local Government Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government Reorganisation (Miscellaneous Provision) (Rush Common) Order 1996 and shall come into force on 26th July 1996.

Amendment of 1988 Order

2.  Article 6 (Rush Common, Brixton) of the Local Government Reorganisation (Miscellaneous Provision) Order 1988(2) shall be amended as follows—

(a)after “under” insert “section 8 of the London County Council (General Powers) Act 1938 (removal of building restriction and widening of Brixton Road) and”(3); and

(b)for “sections 9 to 12 of that Act” substitute “that section and that Part”.

Explanatory Note

(This note is not part of the Order)
This Order makes provision consequential on the abolition of the Greater London Council by section 1 of the Local Government Act 1985.
It amends article 6 of the Local Government Reorganisation (Miscellaneous Provision) Order 1988 so as to enable Lambeth Borough Council to exercise functions in relation to an area of land forming part of Rush Common, Brixton which were formerly exercisable by the Greater London Council but not included among the functions transferred by that article.
