The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of establishments and facilities formerly managed by the Nottingham Health Authority resulting from the establishment of the Nottingham Community Health National Health Service Trust(2), having consulted that Trust and the special trustees for Nottingham University Hospitals in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Nottingham Community Health National Health Service Trust (Transfer of Trust Property) Order 1996 and shall come into force on 31st July 1996.

(2) In this Order—

“the special trustees” means the special trustees for Nottingham University Hospitals;

“the Trust” means the Nottingham Community Health National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the special trustees and the Trust on 26th July 1995, which schedule has been signed on behalf of both the special trustees and the Trust.

Transfer of trust property

2.  On 31st July 1996 the trust property shall be transferred from the special trustees to the Trust.

Explanatory Note

(This note is not part of the Order)
This Order transfers to the Nottingham Community Health National Health Service Trust on 31st July 1996 trust property formerly held by the special trustees for Nottingham University Hospitals. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1N33F, Quarry House, Quarry Hill, Leeds LS2 7UE.
