The Education (Assisted Places) (Scotland) Amendment Regulations 1996

The Secretary of State, in exercise of the powers conferred on him by sections 75A(9) and (10) and 75B of the Education (Scotland) Act 1980(1), and of all other powers enabling him in that behalf, and after having consulted such bodies as appear to him to be appropriate and to be representative of participating schools in accordance with section 75A(11) of that Act, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Assisted Places) (Scotland) Amendment Regulations 1996 and shall come into force on 1st August 1996.

Amendment of Education (Assisted Places) (Scotland) Regulations 1995

2.  The Education (Assisted Places) (Scotland) Regulations 1995(2) are amended as follows:–

(a)after regulation 2(1) (interpretation) add–

“(1A) In these Regulations imperial measurements are supplementary indications of distance.”.

(b)in regulation 5 (conditions as to age and education) for the words “10 years on or before 31st July of” substitute “5 years before 1st March of the calendar year immediately succeeding” and for the words from “comprising” to the end substitute “other than activities in nursery schools and nursery classes”;

(c)in regulation 9(3) and (5) (references to income) for the words “£1,165” in the three places where they occur substitute “£1,200”;

(d)in regulation 13(2) (scales of remission) for the words “£9,711” substitute “£9,873”;

(e)in regulation 15 (school travel grants for day pupils and amounts thereof)–

(i)in paragraph (2) for the words “3 miles each way” substitute “3.2 kilometres (2 miles) each way in the case of pupils whose age does not exceed 8 years and 4.8 kilometres (3 miles) each way in the case of pupils of any other age, in each case the kilometres (miles) being”;

(ii)in paragraph (5)(a) for the words “25 miles” in both places where they occur substitute “40.2 kilometres (25 miles)” and for the words “miles of” substitute “kilometres (miles) of”; and

(iii)in paragraph (6) for the words “£9,724” and “£9,545” substitute “£9,886” and “£9,707” respectively;

(f)in regulation 16 (school travel grants for boarding pupils and amounts thereof)–

(i)in paragraph (3) for the words “3 miles” and “50 miles” in both places where they occur substitute “4.8 kilometres (3 miles)” and “80.5 kilometres (50 miles)” respectively and for the words “miles of” substitute “kilometres (miles) of”; and

(ii)in paragraph (5) for the words “£9,724” and “£9,545” substitute “£9,886” and “£9,707” respectively;

(g)for paragraphs (2) and (3) of regulation 17 (clothing grants) substitute–

“(2) In an assisted pupil’s first assisted year, clothing grant shall be made in the case of such a pupil as respects whom the relevant income does not exceed £11,056 and in such case the grant shall be of an amount equal to so much of the clothing expenditure as does not exceed–

(a)£169, where the relevant income does not exceed £9,707;

(b)£127, where that income exceeds £9,707 but does not exceed £10,159

(c)£83, where that income exceeds £10,159 but does not exceed £10,595;

(d)£43, where that income exceeds £10,595 but does not exceed £11,056.

(3) In any subsequent school year in which clothing grant is made, it shall be made in the case of an assisted pupil as respects whom the relevant income does not exceed £10,595 and in such case the grant shall be of an amount equal to so much of the clothing expenditure disregarding expenditure in respect of which a previous grant has been paid, as does not exceed–

(a)£63, where the relevant income does not exceed £9,873;

(b)£33, where that income exceeds £9,873 but does not exceed £10,595”; and

(h)for Schedule 2 substitute the following Schedule:–

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Education (Assisted Places) (Scotland) Regulations 1995 to do 2 main lots of things in the assisted places scheme.
One is to lower the age limit for children to participate in the scheme to children who have reached the age of 5 or who would reach the age of 5 by the end of February following the start of the school session when they first take up an assisted place (regulation 2(b)).
The other is to amend the amount deducted from income in calculating relevant income, to increase the amounts of relevant income which qualify for remission of fees and charges and for making travel and clothing grants, to increase the amounts of clothing grants and to take account of the lowering of the age for participation, in calculating travel grants (regulation 2(c) to (h)); details are as follows–
(a)the deduction from income for dependent children and relatives which is to be made in calculating relevant income is increased from £1,165 to £1,200 (regulation 2(c));
(b)in respect of the amounts of relevant income–

(i)the amount at or below which fees are to be wholly remitted is increased from £9,711 to £9,873 with corresponding increases in the amounts of relevant income for partial remission where the relevant income exceeds that sum (regulation 2(d) and (h));

(ii)the amounts in respect of school travel grants and clothing grants are increased (regulation 2(e), (f)(ii), (g) and (h));
(c)the taking of account of the lowering of the age in calculating travel grants is in regulation 2(e)(i); and
(d)school clothing grants are increased by amounts varying from £1 to £3 (regulation 2(g)).
Regulation 2(e)(ii) and (f)(i) substitute for imperial measurements metric measurements. Imperial measurements are used as supplementary indications of distance (regulation 2(a), (e)(i) and (ii) and (f)(i)).
