(b) as the Minister deems appropriate or upon request from a coastal
community that is to be allocated a special management area
under section 14(1) of the Act.

(5) Such special circumstances in sub-regulation (4) include where the
application of sub-regulation (1) would mean delimitation through a
reef that is adjacent to the coastal community.

(6) The boundary of a special management area shall be clearly defined
and demarcated in accordance with the guidelines established by the
Ministry.

(7) Prior to allocation of a special management area for a coastal community
under section 14(1) of the Act, the relevant coastal community shall
establish a Committee and prepare its Plan, in accordance with these
regulations.

5. Establishment

A Committee is hereby established for each of the coastal communities
listed in Schedule I.

6. Membership

(1) A Committee shall comprise of the following members:

(a) the Town Officer of the coastal community who shall be the
chairman;

(b) the District Officer of the district within which the coastal
community is situated;

(c) one representative of the Ministry to be nominated by the Secretary;
and

(d) three representatives of the coastal community to be nominated by
the chairman.

(2) The Committee may co-opt any person to participate in meetings and
provide advise.

7. Procedures

The Committee shall determine its own rules and procedures with the
guidance of the Secretary and provided that it complies with the Act and
these Regulations.

8. Election of members

(1) The members of the Committee, other than ex officio members, shall
be elected by a majority vote of the relevant coastal community, in a
meeting convened by the Town Officer and the Ministry.

(Section 15(1) and 101(2)(b))

FISHERIES (COASTAL COMMUNITIES) REGULATIONS 2009

IN EXERCISE of the powers conferred by sections 15(1) and 101(2)(b) of the
Fisheries Management Act 2002, the Minister responsible for Fisheries makes
the following Regulations:

1. Short title

These Regulations may be cited as the Fisheries (Coastal Communities)
Regulations 2009.

2. Interpretation

In these Regulations, unless the context requires otherwise:

“Act “ means the Fisheries Management Act 2002;

“adjacent communities” mean communities situated within the same
district as a coastal community;

“consensus” means the absence of any formal objection made at the
time the decision was taken;

“District” means the districts in Schedule 1 of the District and Town
Officers Act;

“District Officer” means an officer elected under section 4 of the
District and Town Officers Act;

“Committee” means the Coastal Community Management Committee
for a Coastal Community under Regulation 5;

“Fishers Register” is the Coastal Community register of fishers
authorised to fish in a special management area established under
Regulation 16;

“Fishing Vessels Register” is the Coastal Community register of
fishing vessels authorised to fish in a special management area
established under Regulation 16;

“Ministry” means the Ministry of Fisheries;

“Plan” means the fishery plan prepared by the Committee under
regulation 15;

“recreational fishing” means fishing by the method of hook and line
which uses only a single rig or lure, and is limited to a maximum total
daily catch of 3 fish per person;

“subsistence fishing” is defined as fishing for the purposes of household
consumption, not for commercial sale or barter and is limited to a
maximum of 5 kilograms per species per fishing trip, where the
maximum number of species will first be determined by the Committee;
and

“Town Officer” means an officer elected under section 5 of the District
and Town Officers Act.

3. Application

These Regulations shall apply to the coastal communities referred to in
Schedule I and within the boundary of the special management area
designated therein to each coastal community.

4. Boundary of a special management area

(1) The boundary of any special management area declared under section
13(1) of the Act shall:

(a) be measured seaward from the high-water mark of a coastal
community; and

(b) not exceed a distance of 2500 metres from the high-water mark or
a depth of 50 metres.

(2) Where the application of sub-regulation (1) means that the boundaries
of any two coastal communities will overlap, the boundary shall be the
equidistance between such communities.

(3) The Minister may, in consultation with a community’s Committee and
the Fisheries Management Advisory Committee, alter the application
of the boundary under sub-regulation (1) or sub-regulation (2) for the
purposes of ensuring habitat, conservation, management, sustainable
utilisation and development of fisheries resources.

(4) Such alteration of the boundary under sub-regulation (3) shall occur
only:

(a) in special circumstances; and

(2) Such members referred to in sub-regulation (1) shall be elected for a
three-year term and may be elected for a second or subsequent term,
unless the member resigns from the Committee.

9. Quorum

The quorum shall be 4 members including the chairman.

10. Non-attendance at meetings

Where a member of the Committee fails to attend three consecutive meetings
without an appropriate explanation submitted to and accepted by the
Committee, it shall require the resignation of that member and shall appoint
a replacement.

11. Decision-making

(1) The Committee shall make decisions by consensus.

(2) If all efforts to reach a decision by consensus have been exhausted,
decisions by voting shall be taken by a majority of those present and
voting.

(3) Where sub-regulation (2) is applied and there is a tie in the vote, the
Chairman shall have the casting vote.

12. Functions

(1) The function of the Committee shall be to, in cooperation with the
Ministry, assist the coastal community to conduct its operations in a
manner that is conducive to the effective conservation and management
of fisheries resources in its special management area.

(2) Notwithstanding sub-regulation (1), the Committee shall:

(a) prepare a Plan for the conservation, management, sustainable
utilisation and development of fisheries resources for its special
management area to be submitted to the Secretary for approval;

(b) ensure all community members are provided an opportunity to be
involved in the preparation of the Plan;

(c) facilitate meetings or discussions with sectors of the coastal
community such as fishers, women, youth and any other relevant
key stakeholders;

(d) keep the community informed of the Plan with regular community
meetings;

(e) consult with adjacent communities and other stakeholders about
the Plan;

(6) The Committee shall withdraw the name of:

(a) a person or vessel from the appropriate Register for non-compliance
with the conservation and management measures applicable to the
special management area; or

(b) a vessel from the Fishing Vessels Register where the vessel has
been removed from the Fishing Vessels Register maintained by
the Ministry.

(7) Such persons or vessels whose names have been withdrawn under sub-
regulation (6)(a) shall not be allowed to fish in the special management
area until corrective action, as determined by the Committee, is taken,
and their name is reinstated on the appropriate Register.

17. Responsibilities of the Ministry

(1) The Ministry shall provide timely technical advice, assistance and
support to the Committee :

(a) in the preparation of its Plan; and

(b) in accordance with such Plan.

(2) Following receipt of a proposed plan, the Ministry shall conduct
consultations through, but not limited to, the following :

(a) radio announcements inviting comments from any persons or
entities who have an interest in the proposed plan or may be
affected by such plan;

(b) preparation and publication of a notice in a national newspaper,
which includes a summary of the proposed plan, a map of the
special management area, and an invitation for comments to be
submitted, in writing, to the Secretary within 28 days of such
publication;

(c) letter from the Secretary to the District Officer and the Town
Officers of the adjacent communities, which invites comments on
such plan;

(d) in coordination with the relevant District Officer and Town
Officers, conduct individual meetings with adjacent communities
at which written comments on the proposed plan are invited for
submission to the Secretary within 28 days of publication of the
national newspaper referred to in sub-regulation (2)(b).

(3) The Secretary shall:

(f) implement, monitor and conduct annual revision of the Plan;

(g) maintain the fishers register and the fishing vessels register;

(h) assist authorised officers in implementation and enforcement of
the Plan;

(i) stop, board and search any vessel within the special management
area;

(j) require the master or any person aboard to provide information
regarding call sign and country of registration of the vessel and
the names of all persons aboard;

(k) question the master or any person aboard about the cargo, contents
of holds and storage spaces, voyage and activities of the vessel;

(l) where they have reasonable grounds to believe that an offence has
been committed under these Regulations, with a warrant, enter
and search any vessel or premises in which they believe the
offence has been committed;

(m) seize anything which he has reasonable grounds to believe might
be used as an exhibit in any proceedings under this Regulations;
and

(n) issue a written receipt for any article or thing seized and the
ground for such seizure shall be stated in the receipt.

13. Identification

The seizure officer in exercising the powers conferred on him by these
Regulations shall produce identification to show he is a member of the
Committee.

14. Offences

(1) It is an offence for any person to:

(a) assault, obstruct, resist, delay, refuse boarding or entry, intimidate
or fail to take all reasonable measures to ensure the safety of or
otherwise interferes with a member of the Committee in the
performance of his duties;

(b) disobey any lawful order, requirement or request of a member of
the Committee;

(c) use threatening language or behave in a threatening manner or use
abusive language towards a member of the Committee while in
the execution of his duties; or

(d) incite or encourage any other person to assault, obstruct, resist,
delay, refuse boarding or entry, intimidate or fails to take all
reasonable measures to ensure the safety of or otherwise interferes
with a member of the Committee in the performance of his duties.

(2) Any person who commits an offence under this regulation shall be
liable upon conviction to the penalty provided under section 102 of the
Act.

15. Plan

In addition to the relevant requirements for a fishery plan under section 7(2) of
the Act and these regulations, a plan shall contain the following:

(a) a trend analysis which contains details of the past and present
environmental and socio-economic situation of the coastal
community and surrounding area;

(b) a problem analysis of the coastal community and surrounding
area;

(c) a description of the boundary of the special management area, and
justification for such boundary;

(d) a map which illustrates the boundary of the special management
area, including any other management areas within the special
management area; and

(e) a list of Committee members.

16. Registers

(1) The Committee shall establish and maintain a Fishers Register and a
Fishing Vessels Register.

(2) A Fishers Register shall contain the names and details of persons
authorised by the Committee to fish in the special management area.

(3) A Fishing Vessels Register shall contain the name of the owner of the
vessel and details of the vessel authorised by the Committee to fish in
the special management area.

(4) The Committee shall not register a vessel on the Fishing Vessels
Register unless that vessel has been registered on the Register in
section 20 of the Act.

(5) The Committee shall submit copies of both registers to the Ministry,
and promptly inform the Ministry of any additions or deletions from
either of the Registers.

(a) acknowledge receipt of any comment submitted under sub-
regulation (2), within 14 days of receipt of such comment; and

(b) consider such comments submitted under sub-regulation (2) in
accordance with the guidelines established by the Ministry.

(4) Any person aggrieved by a decision made by the Secretary under sub-
regulation (3) may within 14 days of receipt of such decision submit to
the Secretary a written appeal to the Minister.

(5) The Secretary shall submit such written appeal under sub-regulation
(4) to the Minister within 7 days.

(6) Where a written appeal is submitted under sub-regulation (5), the
decision of the Minister shall be binding and final.

18. Authorisations to fish in the Special Management Area

(1) Residents or any person approved by the Committee, shall have their:

(a) names listed on the Register of Fishers; and

(b) vessels listed on the Register of Fishing Vessels.

(2) Persons listed on the Register of Fishers and vessels listed on the
Register of Fishing Vessels in accordance with sub-regulation (1) may
fish within the defined Special Management Area but not within the
Fish Habitat Reserve.

(3) Any other person not listed on the Register of Fishers may apply for a
subsistence fishing permit from the Committee for a single fishing trip
for subsistence fishing purposes only within the Special Management
Area but not within the Fish Habitat Reserve.

19. Subsistence Fishing Permit

(1) The Committee may issue a Subsistence Fishing Permit, provided that
such permit shall be consistent with the Plan, the regulations and the
policies of the Ministry, and shall consider current levels of exploitation.

(2) A Subsistence Fishing Permit shall be made in the form set out in
Schedule II.

(3) A permit issued under sub-regulation (1) shall be cancelled if any
person or vessel is found exceeding any maximum catch limit listed in
their permit.

20. Small Scale Fishing Permit

(1) The Committee may issue a Small Scale Fishing Permit, provided that
such permit shall be consistent with the Plan, the regulations and the
policies of the Ministry, and shall consider current levels of exploitation.

(2) A Small Scale Fishing Permit shall be made in the form set out in
Schedule III.

(3) A permit issued under sub-regulation (1) shall be cancelled if any
person or vessel is found exceeding any maximum catch limit listed
in their permit.

21. Cladosiphon Seaweed Harvesting Permit

(1) The Committee may issue a Cladosiphon Seaweed Harvesting Permit,
provided that such permit shall be consistent with the Plan, the
regulations and the policies of the Ministry, and shall consider current
levels of exploitation.

(2) A Cladosiphon Seaweed Harvesting Permit shall be made in the form
set out in Schedule IV.

(3) A permit issued under sub-regulation (1) shall be cancelled if any
person or vessel is found exceeding any maximum catch limit listed in
their permit.

22. Yacht Fishing Permit

(1) The Committee may issue a Yacht Fishing Permit, provided that –

(a) it has consulted at least half of its members; and

(b) such permits shall be consistent with the Plan, the regulations and
the policies of the Ministry, and shall consider current levels of
exploitation.

(2) A Yacht Fishing Permit shall be made in the form set out in Schedule
VI.

(3) A permit issued under sub-regulation (1) shall be cancelled if any
person or vessel is found exceeding any maximum catch limit listed in
their permit.

23. Fish Habitat Reserve

No person shall access or undertake fishing of any nature in the Fish Habitat
Reserve unless:

(a) the Committee approves accessto the Fish Habitat Reservefor
observation, monitoring and restocking activities;

(b) any other activities (includingmariculture) shall
requiretheendorsement of the Committee andthewritten
authorisation of the Secretaryandbe inaccordance with such
conditions asmay be specified;

(c) the Committee may allow for any tourist activities; or

(d) in an emergency or circumstances involving the immediate safety
of a vessel or its crew.

24. Giant clam and Lobster Protective Zone

No person shall undertake fishing of any nature for giant clam or lobster
in this Protection Zone unless authorised by the Secretary and the
Committee.

25. Conditions of fishing in the Special Management Area

No person shall:

(a) use destructive methods of fishing, such as using metal bars or
iron rods for fishing;

(b) harvest any marine aquarium fish.

(c) in the case of the ‘Atata special management area, harvest
Cladiosiphon sp seaweed without an authorization from the
Committee;

(d) in the case of the ‘Atata special management area, harvest any ark
clam less than 45mm in length as shown in Schedule V;

(e) in the case of the ‘Atata special management area, harvest any
green snail or trochus species;

(f) in the case of the ‘Atata special management area, gut any
Curryfish sp at shore; or

(g) in the case of the ‘Eueiki special management area, catch any
octopus under 1 foot in full body length as illustrated in Schedule
VII.
