NATIONALITY ACT (CAP. 59)



IN EXERCISE of the powers conferred by section 15 of the Nationality Act (Cap. 59)
the Prime Minister with the consent of Privy Council hereby makes the
following Regulations —

1.

(1) These Regulations may be cited as the Naturalization (Amendment)
Regulations 2001.

(2) The Naturalization Regulations 1996 are in these Regulations referred to
as the Principal Regulations.

2. The Principal Regulations are amended by substituting the words “Minister of
Police” with the words “Minister for Foreign Affairs” wherever they appear.

3. Regulation 7 (1) of the Principal Regulations is amended by inserting the
following new paragraph (bb) after paragraph (b) :

“(bb) that he has adequate knowledge of the Tongan language;”.

4. Regulation 8 (2) of the Principal Regulations is amended by inserting the
following words after “consular officer” —

“or senior officer of the Ministry of Foreign Affairs”.

5. Schedule 1 of the Principle Regulations is amended as follows :

(i) In paragraph 16 insert after the words “Previous convictions” the
following :

“(a police report on the applicant must also be attached)”;

(ii) Deleting paragraphs 17 (a) and (b);

(iii) Paragraph 17 (i) is amended by deleting the words “Does he” and
substituting therefor the words “Do you”;

(iv) Paragraph 19 is deleted and substituted with the following:

“19.
The applicant shall supply the names, addresses and relevant contact
details of 2 referees who have known or been closely associated with the
applicant in either or both the applicant’s business and social life during
the preceding 5 years and who have provided satisfactory character
references and letters of support for the applicant which have been
attached to this application form.

(v) Paragraph 20 is deleted and substituted with the following:

“20.
Applicants for naturalization shall sign the following declaration:

Declaration:

I, the undersigned do hereby apply for naturalization as a Tongan citizen under
the Nationality Act (Cap. 59) and do declare : —

That I do not suffer from a contagious or infectious disease which makes my
presence in the Kingdom dangerous to the community;

That I shall if naturalized as a Tongan citizen behave at all times in a manner
that is conducive to peace, good order, good government and public morals;

That I shall uphold all the laws in force in the Kingdom;

That the contents and information provided by me in this form are true and
correct;

That the Immigration section of the Ministry of Foreign Affairs is authorised to
make any inquiries on me or any person included in this application, of any
person who may be able to provide personal information or otherwise on matters
which I have disclosed and which the Ministry of Foreign Affairs may feel
necessary in respect of information provided on this form in order to make a
decision on this application.

6. Schedule 2 of the Principle Regulations is amended as follows:

(i) In paragraph 18 insert after the words “Previous convictions” the
following:

“(a police report on the applicant must also be attached)”;

(ii) Deleting paragraphs 19(a) and (b);

(iii) Paragraph 19 (i) is amended by deleting the words “Does he” and
substituting the words “Do you”;

(iv) Paragraph 21 is deleted and substituted with the following:

8. Schedule 4 of the Principle Regulations is amended as follows:

(i) In paragraph 21 insert after the words “Previous convictions” the
following:
